Investigators from the General Criminal Investigation Directorate of Polda Metro Jaya have withdrawn the persecution case as of today Cristalino David Ozora or David (17) by the suspect Mario Dandy Satriyo (20) et al. Mario Dandy and the suspect Shane Lukas Rotua (19) will be moved to the Polda Metro Jaya Detention Center.

“Later we will transfer it to Polda Metro Jaya detention center, for the effectiveness of the investigation,” said Dirkrimum Polda Metro Jaya Kombes Hengki Haryadi in a press conference at Polda Metro Jaya, Jakarta, Thursday (2/3/2023).

At the moment Mario and Shane still in the detention center Polres Metro Jakarta Selatan. However, for the sake of efficiency, both of them will be moved to Polda Metro Jaya detention center.

“Yes (still at the South Jakarta Police detention center). Because today we are new, today we are holding a withdrawal for the efficiency of the investigation process,” he explained.

Investigation Withdrawn to Polda Metro Jaya

Investigators from the General Criminal Investigation Directorate of Polda Metro Jaya have withdrawn the case of the persecution of Cristalino David Ozora or David (17) by the suspect Mario Dandy Satriyo (20). The investigation into the Mario Dandy case is now being handled by Polda Metro Jaya on the grounds that it will make the investigation process easier.

“In the context of optimizing the investigation and the efficiency of this investigation, today we are withdrawing it to Polda Metro Jaya,” said Dirkrimum Polda Metro Jaya Kombes Hengki Haryadi to reporters at Polda Metro Jaya, Jakarta, Thursday (2/3/2023).

Hengki Haryadi explained the reason for his side withdrawing the Mario Dandy case. One of them is that the Ditreskrimum Polda Metro Jaya has a lot of investigative human resources in handling cases involving women and children.

In addition, the Polda Metro Jaya Ditreskrimum has also implemented an interprofessional collaboration pattern by involving experts from various scientific fields.

“Why, because we apply an interprofessional collaboration pattern to facilitate coordination and we have more investigators who specifically investigate cases involving women and children,” explained Hengki.

Hengki Haryadi added that this case was originally handled by the Pesanggrahan Police, who at that time had already named one suspect, namely Mario Dandy. However, because the Polsek did not have a special unit dealing with women and children’s issues (PPA unit), the investigation was withdrawn to the South Jakarta Metro Police.

During their journey, the South Jakarta Metro Police have named two suspects, namely Mario Dandy and Shane Lukas Rotua (19).

So far, there have been no additional suspects in this case. In this case Polda Metro Jaya will involve a number of experts from several relevant stakeholders, bearing in mind that this case involved witnesses and also underage victims.

The new police increased the status a woman with the initials AG alias A (15) as the perpetrator in the case Mario Dandy Satriyo (20) in the persecution of Cristalino David Ozora alias David (17). AG’s status was only upgraded after the investigation into the case took place 10 days after the persecution that occurred on February 20, 2023.

“Why does this increase in status take so long, we have to follow the procedures in the Juvenile Justice System Law,” said Dirkrimum Polda Metro Jaya Kombes Hengki Haryadi in a press conference at Polda Metro Jaya, Thursday (2/3/2023).

In addition to procedures for the Law on the Juvenile Justice System, continued Hengki, the police involved many experts for research. Examination and series of tests also take time.

“We have to involve social workers to carry out research, we have to involve a psychology team to carry out examinations and a series of tests that take a long time,” he explained.

Hengki Haryadi explained, in handling this case, investigators faced 2 groups of legal subjects. The first is the adult offender.

“Then we also face two legal subjects, namely children who are in conflict with the law, namely the first child as a victim and the second child as a witness. The second is a child who is in conflict with the law,” he said.

Therefore, investigators need to be careful, so they need to invite partners so that the fulfillment of children’s rights is still fulfilled. In investigating this case, investigators invited the Indonesian Child Protection Commission (KPAI), the Ministry of Women’s Empowerment and Child Protection (KemenPPPA), juvenile criminal experts, criminal experts, and others.

“In the process of our investigation, we are still carrying out the investigation pattern scientific crime investigation,” added Henry.

AG Status Becomes Actor

AG female status regulated in the Law on the Juvenile Criminal Justice System. Previously, he was referred to as a child in conflict with the law or a witness, but now his status has increased as a child in conflict with the law, which is a term for children who commit crimes or are perpetrators or child suspects.

“Secondly, there is a change in status from AG, which initially a child is in conflict with the law, changes status or increases in status to a child in conflict with the law or in other words changes to a perpetrator or a child. “Towards AG’s children, we apply Article 76C juncto Article 80 of the Child Protection Act, Article 355 paragraph (1) of the Criminal Code juncto Article 56 of the Criminal Code subsidiary Article 354 (1) juncto Article 56 more subsidiary Article 353 (2) juncto Article 56 is more a subsidiary Article 351 (2) juncto Article 56 of the Criminal Code,” said Hengki.
