When does insurance pay for wasps and bees?

A wasp nest on the house usually requires professional help – removing it yourself is prohibited. Special operations can be expensive. Will insurance cover it?

If the nests are in particularly difficult to reach or dangerous places on the house or under the roof, where normal ladders or scaffolding are not sufficient, it may even be necessary to use a crane. Such operations are rare, but they do occur.

The costs for such a special operation can be considerably higher than for a normal removal. However, in some cases, the building insurance may cover the costs. The Homeowners’ Association for Housing (WiE) points this out.

As a rule, the costs of removing a wasp or bee nest must be borne by the owner or tenant. So if you cannot avoid relocation or removal, you should check your own insurance documents, advises WiE board member Sandra von Möller.

Some home insurance policies offer special home and apartment protection policies that cover the removal of wasp and hornet nests as well as beehives up to 300 euros per claim. In rented apartments, the landlord is responsible for removing them, as a wasp nest is considered a defect in the rental property.

If the contract does not contain a corresponding clause, including one could be worthwhile, especially for those who frequently have problems with wasp, bee or hornet nests, Sandra von Möller continues.

If the use of special equipment such as a crane or a work platform is necessary, the costs can be considerably higher than for normal professional removal.

Standard costs for removing a wasp nest are between 50 and 150 euros, but for nests that are difficult to access, the cost can be up to 250 euros. Using a crane or scaffolding is significantly more expensive. It can be assumed that the costs in such cases can amount to several hundred euros.

The exact costs depend on the size and type of crane required, the duration of the job, the level of difficulty and any additional safety measures, such as the closure of footpaths or roads.

It is definitely advisable to obtain several quotes before undertaking such a complex operation and to clarify with your insurance company whether the costs can be covered. The consumer advice center generally recommends calling in a pest control expert. This will also protect you from dubious pest controllers who charge a lot of money to remove wasp nests.

February 19, 2024 – Anyone who carelessly increases their transfer limit as part of a phishing attack and thereby enables online fraudsters to access their bank account is acting with gross negligence. He therefore has no right to have his financial institution credit his account with the money stolen by the fraudsters. The Frankfurt am Main Higher Regional Court decided this in a judgment of December 6, 2023 (3 U 3/23) published on Wednesday, thereby confirming a decision of the lower court.

In September 2021, a lawyer and tax advisor working in an international law firm received a text message that purportedly came from his savings bank. He was informed that his account had been restricted. He should register for a new procedure as part of online banking and follow a web link.

Fraudsters caused the transfer limit to be increased

Since the link contained the word Sparkasse and a telephone number that the financial institution had already used in the past to inform the customer about temporary closures following security incidents, he was not suspicious. So he followed the link.

The lawyer was then called by an alleged employee of the savings bank. This prompted him to do so by means of a so-called PushTAN and verification via facial recognition to temporarily increase the daily transfer limit from 10,000 euros to 50,000 euros.

Shortly afterwards, his account was debited with a transfer of 49,999.99 euros. An unknown male person was named as the recipient of the money.

After the injured party unsuccessfully requested that his financial institution credit the stolen amount back to his account, he filed a lawsuit with the Frankfurt regional court. However, this considered his claim to be just as unfounded as the higher regional court of the city on the Main, which dealt with the case in the second instance.

Bank customer acted with gross negligence

After taking evidence, the judges were convinced that the plaintiff had not, as he claimed, confirmed something in his PushTAN app using facial recognition not just once, but several times. Because there was no other way for the perpetrator to transfer the almost 50,000 euros from his account given the sophisticated security system.

Furthermore, by confirming PushTANs at the caller’s request, the plaintiff violated his obligation to protect security features from unauthorized access and thus granted an unknown third party access to a personalized security feature.

In doing so, he effectively placed control of the authentication instrument in the hands of the caller. He therefore had to accept the accusation of having acted with gross negligence.

When the release request is requested, the account holder is generally shown which specific process, such as a transfer, requires authentication. The specific amount of the money transfer is also mentioned.

Known attack pattern phishing

“If a customer does not heed these clear instructions and gives approval without paying attention to the ad, this is not simply a negligent breach of duty,” explained the Higher Regional Court.

When using an app that is explicitly used to approve financial transactions, it must generally be clear to everyone that the ad must not only be acknowledged, but also thoroughly checked. This applies even more in the present case given the plaintiff’s professional qualifications.

In addition, customers of financial institutions have been warned about phishing attacks for years. Among other things, it should be noted that fraudsters give the impression that their message comes from a payment service provider. However, the links in such messages typically lead to fake websites.

After all of this, the plaintiff is now almost 50,000 euros poorer.

A decision has not yet been made regarding whether an appeal will be permitted

The judges saw no reason to allow an appeal against their decision to the Federal Court of Justice.

In the meantime, the plaintiff has defended himself against this with a non-admission complaint. The BGH has not yet decided on this.

A model customer was defined for the comparison. Premiums were calculated for him with a deductible of 300 euros for fully comprehensive insurance and 150 euros for partial comprehensive insurance.

At peak savings of 42 percent are possible on vehicle insurance

The result: According to the comparison portal, insured people pay up to 42 percent less on their annual vehicle premium if they decide on a deductible. On average, the premium costs fall by 28 percent for a fully comprehensive tariff with a deductible of 300 euros. The model customer pays an average of 450 euros less.

As a rule, a deductible pays off after just over a year without claims, according to the insurance broker. In fact, full cost coverage by the insurer is only advisable for insured parties who cause damage at least once a year.

Anyone who reduces their mileage by 5,000 kilometers to 10,000 kilometers can save an average of 16 percent or around 170 euros.

10,000 kilometers more cost a 30 percent surcharge

The risk of an accident increases with every kilometer. The premium also increases accordingly. According to the analysis, frequent drivers who drive 25,000 kilometers a year have to pay an average of 30 percent more than a driver who drives 15,000 kilometers a year.

A workshop bond brings a discount of up to 36 percent. On average, there is a twelve percent discount (130 euros) on the vehicle insurance premium.

On average, insured people receive a further six percent or 89 euros discount if they switch from monthly to annual payment.

In individual cases the surcharges can even be up to 491 euros. If you pay quarterly or semi-annually, drivers leave an average discount of six or four percent. Conversely, an insurer discounts monthly payments by up to 22 percent and quarterly payments by up to 24 percent.
