Senate investigators have obtained a copy of Dr. Anthony Fauci’s pandemic-era cellphone from the Department of Health and Human Services, according to Fox News Digital reporting. The transfer to the Senate Homeland Security Permanent Subcommittee on Investigations occurs as the panel prepares to weigh contempt charges following Fauci’s invocation of the Fifth Amendment.

The Department of Health and Human Services transferred the cellphone used by Dr. Anthony Fauci during his federal tenure to the Senate Homeland Security Permanent Subcommittee on Investigations. Chaired by Sen. Ron Johnson, a Republican from Wisconsin, the subcommittee secured the device as part of its ongoing oversight into federal pandemic policies. A spokesperson for Johnson confirmed to Fox News Digital that the panel obtained a copy of the phone, though the extent of the data accessible to investigators remains under review.

The acquisition of the digital device, initially reported by the Wall Street Journal, coincides with preparations by the Senate Homeland Security and Governmental Affairs Committee to determine whether to hold Fauci in contempt of Congress. The investigative push has involved extensive document disclosures, including a release by HHS of more than 1,000 pages of Fauci’s personal diary to the panel just days before a high-stakes legislative hearing.

Subpoena and Fifth Amendment Invocation Before the Panel

The inquiry centers on a subpoena issued by Sen. Rand Paul, a Republican from Kentucky, directing Fauci to testify regarding his alleged role in funding gain-of-function research in Wuhan, China, where the COVID-19 virus originated. Paul has publicly advocated for severe legal consequences, questioning federal pandemic management and accusing Fauci of misleading Congress during prior testimonies.

During the scheduled hearing, Fauci declined to answer direct inquiries. Acting on the advice of legal counsel, he invoked his rights under the Fifth Amendment of the United States Constitution, citing concerns about self-incrimination before a panel he characterized as structured to target him.

“Although it pains me to do so because of the respect I have for the legislative branch of government, and my decades-long record of cooperating with Congress under the advice of my attorneys, I will invoke my right under the Fifth Amendment of the Constitution to refrain from answering your questions,” Fauci stated during the proceedings.

The decision prompted sharp divisions among committee members. Republican lawmakers pressed Fauci on various aspects of pandemic origins, including the lab leak hypothesis and operational timelines, while Democratic members defended his use of constitutional protections against what they described as a politically motivated inquiry designed to manufacture contradictions.

Legal Questions Surrounding Presidential Pardons and Contempt

The confrontation culminated in warnings from Paul regarding potential legal fallout for declining to testify. The Kentucky senator raised questions regarding the legal scope of a presidential pardon issued by former President Joe Biden and whether it provides blanket immunity against congressional contempt citations.
