Missouri GOP Win in Redistricting Case Heads to State Supreme Court

Cole County Judge Daniel Green upheld Missouri Secretary of State Denny Hoskins’ decision to block a referendum targeting the state’s newly redrawn congressional maps, delivering a win to Republican lawmakers seeking to safeguard their legislative advantage ahead of the upcoming midterm elections.

The legal battle centers on a map pushed through the state legislature following a national Republican push to secure favorable congressional boundaries. That map specifically altered the lines around Kansas City to target long-serving Democratic Representative Emanuel Cleaver’s seat, according to reporting by NOTUS. In response, a group named People Not Politicians gathered over 30,000 signatures to trigger a statewide referendum. Secretary of State Denny Hoskins rejected that petition on August 4, calling the challenge unconstitutional and setting the stage for the courtroom showdown in Cole County.

Judicial Rationale and the Prohibition of Mid-Cycle Referenda

Judge Green’s ruling rested on historical precedent and state constitutional interpretation regarding legislative authority over federal elections. In his written opinion, Green emphasized that Missouri law has never subjected congressional redistricting to public referenda.

“Missouri has never — by constitutional provision, by statute, or by practice — subjected congressional redistricting to the referendum,” Green wrote, as noted by NOTUS. The court found that framers and legislators had either remained silent or affirmatively rejected referendum mechanisms for congressional maps.

Furthermore, Green cited federal election constraints given the tight calendar leading up to the general election. Because the contested maps had already been utilized during the state’s primary elections, the court argued that altering boundaries at this stage would violate the Equal Protection Clause by generating two distinct classes of voters—those who had the opportunity to select their general election candidate and those who did not.

Expedited Appeals and the September 8 Ballot Deadline

The legal dispute is far from over despite Wednesday’s setback for map opponents. Richard von Glahn, executive director of People Not Politicians, confirmed that the coalition intends to fight the ruling in the state’s Supreme Court.

“The most important thing that happened today is that there was a ruling,” von Glahn said in a statement reported by NOTUS. “The State has tried to slow down the judicial process for months and now that we are out of Cole County, the real decision will be made. Our case now moves forward.”

With Missouri law mandating that general election ballots be finalized by September 8, the timeline is compressed. Chief Justice Brent Powell has ordered an expedited review of the case, scheduling oral arguments for September 2. This leaves the Missouri Supreme Court to decide whether the Republican-backed map will govern the November midterms.
