MI5 Spared Contempt of Court Charges Over False Evidence, Judges Rule

London Court Clears MI5 of Contempt Charges Over False Evidence

Senior judges ruled that MI5 and its staff will not face contempt of court proceedings despite the security agency admitting that its evidence given to three separate courts was a lie, according to bbc.co.uk. Delivered by a panel including Lady Chief Justice Baroness Sue Carr alongside Dame Victoria Sharp and Mr Justice Chamberlain, the decision concludes that a contempt case would be too complex for the court to manage and therefore not in the public interest to pursue.

The Genesis of the Deception: Agent X and BBC Discussions

The false evidence was presented during legal proceedings concerning an abusive informant known as Agent X. It involved conversations between MI5 and the BBC regarding the agency’s efforts to expose him.

MI5 Avoids Contempt Proceedings After False Evidence Given to Three Courts

In July 2025, the three judges asked MI5’s watchdog to investigate the origin of the false statements. In July this year, an investigation by Sir John Goldring—ordered by the prime minister—concluded that one senior MI5 officer lied repeatedly while another misled colleagues and lied about instructions received. The report detailed serious and systemic failures in MI5’s conduct, prompting the security service to accept the findings without reservation in September.

Police Possess Investigatory Powers for Potential Criminal Charges

While escaping contempt of court proceedings, individual MI5 officers may still face criminal investigation. The High Court panel ruled that the police possess the appropriate investigatory powers and resources to handle the matter. The Crown Prosecution Service would then decide whether to bring charges such as misconduct in public office or perverting the course of justice.

The Home Office declined to clarify whether it would formally refer the case to the police, noting that officials are still assessing the judgment. One of the heavily criticized officers has resigned, while the other faces internal disciplinary proceedings.

Sir Ken McCallum Issues Renewed Apology for Failures

Sir Ken McCallum welcomed the court’s decision while acknowledging the severity of the findings. He issued a renewed apology for the failures and for the additional distress caused to Beth.

MI5 Avoids Court Sanction Over False Evidence Presented to Multiple Courts

Meanwhile, investigatory powers commissioner Lord Leveson stated last week that the case was as “serious as anything” he has faced in his role. Legal experts and defense practitioners observe that the outcome contrasts sharply with ongoing contempt proceedings faced by other legal figures, while leaving the consistency of accountability within the security establishment unclear.
