Lawsuit Filed Against Council of Ministers Over Plus Ultra Rescue in Zapatero Case

Attorney Luis María Pardo has formally petitioned the Spanish Supreme Court to investigate the Council of Ministers regarding the 2021 financial bailout of Plus Ultra Líneas Aéreas.

The Legal Challenge Against the Council of Ministers

Luis María Pardo, a prominent figure in the legal challenges often referred to as the ‘Zapatero case,’ has moved to hold the executive branch accountable. The complaint, initially filed in May and ratified in late June, seeks to identify the specific individuals or entities within the Council of Ministers who facilitated the state-funded rescue of the airline.

Pardo maintains that the timing of the operation is fundamentally suspicious. He points to public statements made by Julio Martínez, which suggested that the airline was aware of the impending bailout nearly 15 days before the official announcement. According to Pardo, this knowledge could not have been obtained without direct communication from someone with authority inside the Council of Ministers.

The legal strategy hinges on the assertion that the involvement of high-ranking government officials necessitates the intervention of the Supreme Court. Because the individuals potentially involved may hold special protected status (aforados), the case falls outside the jurisdiction of lower courts. Pardo asserts that there are “rational indications” of wrongdoing that warrant a full investigation into the decision-making process.

The core question driving this litigation is simple but profound: Who specifically exerted influence to secure the bailout for Plus Ultra? Pardo argues that the Council of Ministers is the only body with the requisite power to authorize such a financial intervention.
