Kalshi operates as the first fully regulated U.S. exchange for event contracts, holding a designation as a contract market under the U.S. Commodity Futures Trading Commission (CFTC). Founded in 2018 by MIT graduates Tarek Mansour and Luana Lopes Lara, the platform allows users to trade binary contracts on outcomes spanning politics, economic data, and sports. Unlike traditional offshore betting sites or commercial sportsbooks, the exchange functions under federal commodities law, which makes insider trading a criminal offense and subjects all participant funds to futures-style protections.

Despite capturing roughly 60% of global prediction-market volume through 2025 and regularly out-trading crypto-native competitors like Polymarket by more than $2 billion a month within the U.S., Kalshi faces regulatory pushback. Over ten states have pursued legal challenges, claiming that the platform’s sports-related event contracts infringe upon state-level gambling statutes. The current standoff in Nevada intensified when the state’s gaming regulator moved to impose daily penalties, prompting the exchange to push back on jurisdictional boundaries.

The Regulatory and Legal Landscape

Federal oversight establishes a distinct barrier against market manipulation. Under CFTC rules, participants are strictly prohibited from trading on material, non-public information. Violations carry the same severe penalties associated with stock or commodity market manipulation, distinguishing the exchange model from traditional state-regulated sports betting applications where infractions typically result in simple account suspensions.
