ICC ends insurance contract with French insurer AXA

The International Criminal Court has ended its insurance contract with French life and health insurer Axa and will be using a new health insurance provider, a spokesperson for the Hague-based court said.

The contractual split took effect on October 1, according to a spokesperson for the tribunal. Neither the ICC nor Axa provided specific reasons for the discontinuation during initial inquiries, and the court declined to name its new health insurance provider.

“Axa and the Court have decided by mutual agreement to terminate the contractual relationship,” an ICC spokesperson told Reuters in a statement. Axa did not immediately respond to requests for comment.

Extraterritorial Sanctions Collide with European Insurance Operations

The Financial Times reported that Axa pointed to risks arising from the extraterritorial application of US sanctions. The insurer described an international environment that has grown increasingly tense and complex for businesses operating across multiple jurisdictions. The decision followed months of internal discussions alongside talks with the tribunal regarding potential operational workarounds.

Those talks failed to identify a viable solution absent a blocking statute. Blocking statutes serve as legal mechanisms designed to shield European entities from the reach of foreign sanctions imposed by third countries. Without such legislative cover, multinational firms often reassess high-visibility public sector contracts to mitigate compliance exposure.

The administrative shift arrives amid an intense American campaign against the tribunal. President Donald Trump recently urged other nations to leave the ICC, branding the institution as evil and a rogue entity. The Trump administration argues that the court oversteps its mandate by asserting jurisdiction over citizens of countries, including the United States and Israel, that have not ratified the court’s founding treaty, known as the Rome Statute.

Financial Penalties and Operational Constraints on Tribunal Staff

The United States has already imposed financial penalties and visa bans on ICC personnel. Sources familiar with the matter previously told Reuters that officials had prepared additional sanctions capable of undercutting the court’s daily operations.

These restrictive measures create distinct challenges for corporate service providers and financial institutions handling administrative accounts for international organizations. Enterprises facing complex regulatory overlaps typically consult with specialized corporate legal advisors and compliance risk management firms to audit their contractual exposures before jurisdictions conflict.
