Hong Kong Researchers Urge Binding Sentencing Guidelines for Child Sexual Abuse Crimes

Hong Kong Researchers Urge Binding Sentencing Guidelines for Child Sexual Abuse Crimes

October 22, 2026 Emma Walker – News Editor News

Researchers in Hong Kong are calling for binding sentencing guidelines for child sexual abuse cases, citing data that shows prison terms for the city’s most severe offences have remained significantly lower than the statutory maximum of life imprisonment. Data analyzed by the University of Hong Kong (HKU) reveals that average sentences for the six gravest penetrative crimes have consistently fallen below 10 years over the last three decades.

Data from 401 Judicial Decisions

A study conducted by the Law and Social Justice Clinic at the HKU Faculty of Law examined 401 publicly available judicial decisions delivered between 1968 and 2025. The research, presented on October 20, 2026, focused on six specific offences: incest by men, rape, non-consensual buggery, homosexual buggery with or by a man under 16, buggery with a girl under 21, and intercourse with a girl under 13, as reported by Hong Kong Free Press.

The findings indicate that life imprisonment—a penalty available for all six offences—has been used only twice, with both instances occurring in 1968 and 1972. In the period spanning 1990 to 2025, average sentences for these crimes ranged from 4.61 years for intercourse with a girl under 13 to 9.82 years for rape.

Offence Average Sentence (Years)
Intercourse with a girl under 13 4.61
Homosexual buggery (male under 16) 5.03
Male Incest 7.70
Non-consensual buggery 9.50
Rape 9.82

Calls for a Sentencing Council

Puja Kapai, an associate professor at the HKU Faculty of Law, stated that the goal of the proposed guidelines is not to mandate maximum sentences in every instance, but to ensure consistency and transparency in how aggravating and mitigating factors are weighed. Speaking at a press conference on October 20, 2026, Kapai suggested that Hong Kong could adopt a framework similar to the UK’s Sentencing Council, which provides clear guidance on the range of penalties appropriate for specific crimes.

The research identified a downward trend in sentencing for several of these offences. Specifically, the average sentence for unlawful intercourse with a girl under 13 dropped from a range of 10 to 12 years in the mid-2000s to under five years in more recent cases.

Limitations of Judicial Sentencing

The report argues that the current judicial approach often places undue weight on the concept of consent from children, a factor that researchers suggest fails to account for developmental immaturity and the power dynamics inherent in child abuse cases. Taura Edgar, founder and chairperson of the NGO TALK Hong Kong, emphasized that the justice system alone cannot resolve the issue, noting that an estimated 96 percent of child sexual abuse cases in the city are never reported to authorities.

Prevention Initiatives

To address the preventative gap, TALK Hong Kong has launched a platform titled Stop It Now HK. Modeled after programs in the United Kingdom, Australia, and the United States, the platform offers anonymous resources for individuals concerned about their own thoughts or behaviors toward children. The initiative aims to provide a safe space for self-help and intervention, potentially diverting individuals from committing offences.
