HHS Clears Pharmacists to Dispense Unapproved Peptides Under New Policy

HHS Clears Pharmacists to Dispense Unapproved Peptides Under New Policy

October 29, 2026 Emma Walker – News Editor News

American consumers should not be treated like guinea pigs, said Fred Mills, chief policy officer for Americans for Safe and Effective Medicines, in a statement regarding a major federal shift on injectable amino acid chains. “It is possible to advance both patient safety and access to legitimate medicines, but this is not it.”

The U.S. Department of Health and Human Services announced on October 28 that it will not take enforcement action against licensed pharmacists who dispense specific unapproved peptides to consumers. The policy, signed by HHS Secretary Robert F. Kennedy Jr., marks a dramatic pivot from the U.S. Food and Drug Administration’s 2023 restrictions on the substances. HHS Secretary Robert F. Kennedy Jr. has said in the past that he is a “big fan” of the unapproved drugs, whose benefits are largely scientifically unproven.

HHS Directive Allows Compounding of Six Specific Peptides

The new directive targets six specific compounds outlined in an appendix document posted on the HHS website. According to the notice set for the Federal Register publication on October 30, state-licensed pharmacies, federal facilities, and licensed physicians may compound drug products using BPC-157, Epitalon, KPV, MOTS-c, Semax, and TB-500 without facing federal penalties.

HHS stated that the decision aims to expand patient access following significant consumer interest.

Hims & Hers Shares Rise as Peptide Market Grows

Shares of Hims & Hers surged 5% following the October 28 announcement as the company prepared to integrate peptides into its offerings for 2026. Industry analysts estimate that the broader commercial market for peptide products could reach up to $3.3 billion.

Lee Rosebush, chair of the American Academy of Peptide Medicine, stated that the shift represents a vital step toward eliminating unsafe gray and black markets while restoring safe patient access through physician-supervised care.

Medical Professionals Warn Against Untested Experimental Drugs

Medical professionals and consumer advocates expressed sharp opposition to the enforcement discretion. Dr. Adriane Fugh-Berman, a professor of pharmacology and physiology at Georgetown University Medical Center, testified during the July committee meetings that the substances under consideration are untested and poorly characterized experimental drugs. She pointed to an incident in Las Vegas where two women required emergency medical treatment after receiving peptide injections.

Immediate Telehealth Dissemination

Shortly after the policy notice became public, multiple telehealth platforms began marketing the six approved peptides directly to consumers. Pricing for the unapproved treatments ranged from $199 to $249 per month, setting the stage for widespread adoption ahead of the formal Federal Register publication. Compounding can and should play a legitimate clinical role, from hospitals to home infusion to filling gaps during drug shortages, she noted.
