Green Card Processing Delays Threaten Health Coverage for Refugees and Asylees

Green Card Processing Delays Threaten Health Coverage for Refugees and Asylees

October 17, 2026 Dr. Michael Lee – Health Editor Health

Citizenship and Immigration Services reported over 275,000 pending green card applications from refugees and asylees, a backlog that directly intersects with new federal eligibility restrictions on public health coverage. According to an analysis published by KFF, the combination of mounting administrative delays and the 2025 reconciliation law leaves humanitarian migrants facing extended periods without access to Medicaid, the Children’s Health Insurance Program, Medicare, and subsidized Affordable Care Act Marketplace plans.

Refugees and asylees must wait one year after arrival or after being granted asylum before filing Form I-485 to adjust their status to Lawful Permanent Resident. Historically exempt from the standard five-year waiting period required for many other lawfully present immigrants to access federally funded care, these populations now face strict new coverage limitations tied directly to holding a green card.

Key Clinical Takeaways:

  • Green card processing backlogs at USCIS mean refugees and asylees wait significantly longer for approvals, with average wait times reaching 13.3 months for refugees and 19.9 months for asylees between fiscal years 2025 and 2026.
  • The 2025 reconciliation law eliminated longstanding exemptions, restricting federally funded health coverage such as Medicaid and CHIP for refugees and asylees who do not yet hold a green card.
  • State policies vary widely, leaving adults with disabilities and older adults with limited alternatives outside of fully state-funded health coverage where available.

Legislative Restrictions Take Effect as Processing Speaks to Delays

Under the 2025 reconciliation law, federally funded health assistance has been curtailed for several groups of lawfully present immigrants without permanent residency status. The restrictions on Medicaid and CHIP took effect on October 1, 2026, while restrictions covering Medicare and subsidized Marketplace plans are scheduled to take full effect in January 2027. The Congressional Budget Office estimates these eligibility changes will result in approximately 1.4 million individuals becoming uninsured by 2034.

While USCIS application receipts for refugees increased by about 10 percent between the first three quarters of fiscal year 2025 and fiscal year 2026—rising from 59,754 to 66,013—applications received for asylees dropped by roughly 32 percent, falling from 58,682 to 40,344 over the same timeframe.

Completed Applications Fall Sharply While Backlogs Grow

Despite the volume of incoming paperwork, the rate of completed adjudications by USCIS dropped significantly. Between the first three quarters of fiscal year 2025 and fiscal year 2026, completed I-485 applications fell by about 90 percent for refugees, dropping from 37,908 to 3,805.

By June 30, 2026, pending applications reached 149,470 for refugees and 126,267 for asylees, totaling 275,737 pending cases. Average processing times worsened correspondingly, expanding from 7.8 months to 13.3 months for refugees, and from 10.7 months to 19.9 months for asylees, with quarterly figures within fiscal year 2026 climbing even higher.

State Options Vary for Immigrant Health Coverage

The impact of these federal changes varies considerably depending on geography. 38 states utilize options under the Children’s Health Insurance Reauthorization Act to provide coverage to lawfully present immigrant children without a waiting period, while 32 states offer the same option to pregnant individuals, and about half of states provide prenatal coverage regardless of immigration status.

For adults with disabilities, older adults, and refugees living in states without extended programs, public insurance options remain scarce. California will continue covering all noncitizens affected by these changes through June 2027 using fully state-funded options. In response to these coverage gaps, community organizations, resettlement agencies, and state agencies are exploring partnerships with community health clinics and organizing health fairs to help affected individuals manage unmet medical needs.
