Ex-Police Detective Matthew Farwell Murder Trial Set to Begin in Boston
Federal judge Denise Casper denied a defense motion to move former Stoughton police detective Matthew Farwell’s murder trial out of state, ruling that pretrial publicity does not prevent an impartial jury selection in Boston federal court.
Judge Denies Venue Change in Farwell Murder Case
- Case Background: Former Massachusetts police officer Matthew Farwell faces federal charges for the February 2021 murder of 23-year-old Sandra Birchmore during a Nor’easter.
- Legal Proceedings: U.S. District Court Judge Denise Casper denied the defense motion for a venue change, clearing the path for jury selection to begin on Tuesday, Oct. 6.
- Evidence Rulings: The court ruled that Birchmore’s journals and medical history are admissible, while DNA testing established that Farwell was not the father of her unborn child.
Venue Change Denial and Trial Schedule in Boston Federal Court
Matthew Farwell’s federal public defenders argued that substantial local media coverage created a presumption of prejudice, preventing a fair trial in Massachusetts. U.S. District Court Judge Denise Casper rejected that argument on Thursday morning, ruling that the defense failed to meet the high burden required for a transfer of venue. Prosecutors successfully maintained that the standard juror questionnaire and voir dire process will effectively identify and screen out any prospective jurors with pre-existing bias. A final pretrial conference is scheduled in Boston federal court on Friday at 11 a.m., immediately preceding jury selection, which is set to begin on Tuesday, Oct. 6.
Prosecutors Allege Farwell Killed Birchmore to Hide Exploitation
Federal prosecutors allege that Matthew Farwell, a married father of three, traveled to Sandra Birchmore’s Canton apartment during a severe blizzard in February 2021 and killed her before staging the scene to mimic a suicide. At the time of her death, Birchmore was 23 years old and eight to 10 weeks pregnant. Investigators assert the homicide was executed to conceal years of ongoing sexual exploitation that allegedly began when Birchmore was 15 and Farwell was 27, having met her through the Stoughton Police Department’s Police Explorers Program in 2013. While initial local investigations by the Norfolk County District Attorney’s Office ruled the death a suicide, private investigators hired by Birchmore’s estate and a subsequent federal probe led to Farwell’s arrest in August 2024, after which he has been held without bail.
Disputed Paternity and Admissibility of Personal Records
Legal arguments leading up to the trial involved contested forensic evidence and personal documentation. While Birchmore had told Farwell he was the father of her child, subsequent DNA testing confirmed that Jason Pickard is the actual father, a fact confirmed by Farwell’s defense attorneys during recent court proceedings. Judge Casper additionally ruled that Birchmore’s medical history and personal journals will be admissible during the trial, despite defense arguments highlighting her past suicide attempts. The defense maintains that Birchmore took her own life, while federal prosecutors maintain that Farwell committed the murder and manipulated the crime scene.
