The Court of Appeal of Recent Zealand has granted Forest & Bird abandon to appeal a portion of the decision approving a large-scale landfill in Auckland’s Dome Valley, reigniting a legal battle over the project’s potential environmental impact. The appeal, lodged in early 2026, will focus on the protection of waterways threatened by the proposed 80-hectare facility, intended to manage roughly half of Auckland’s annual waste stream. The contested landfill, situated five kilometers from Warkworth, has faced sustained opposition from environmental groups and local iwi due to concerns over the destruction of approximately 12 kilometers of streams within the valley. Forest & Bird’s legal challenge centers on the interpretation of the National Policy Statement for Freshwater Management and whether it permits the removal of streams to accommodate landfill development. Senior environmental lawyer May Downing stated the case addresses a fundamental question: “These aren’t just rivers that’s nice to glance at they’re essential habitat for indigenous fresh water species,” and expressed concern over “the normalisation of river loss.” The Dome Valley is a recognized biodiversity hotspot, providing habitat for Hochstetter’s frogs, native freshwater fish, long-tailed bats (pekapeka-tou-roa), and a variety of bird species. The approval process has also raised questions about the efficacy of mitigation strategies, such as riparian planting, to offset the ecological damage caused by stream destruction. Waste Management, the project developer, initially proposed a mitigation package including up to 60km of riparian planting in the Hoteo catchment of the Kaipara Harbour, or alternatively, a $10 million contribution towards such works. The current legal challenge follows a series of previous rulings. Auckland Council initially granted conditional approval in 2021. The Environment Court provisionally granted consent in 2023 following appeals from iwi and community groups. Subsequent appeals to the High Court in 2024 were dismissed. Forest & Bird then sought leave to appeal that decision in the Court of Appeal, resulting in the partial grant of appeal rights earlier this year. Waste Management, along with Manuhiri Kaitiaki Charitable Trust, Ngāti Whātua Ōrākei Whai Maia, and Environ Holdings, had opposed Forest & Bird’s application for appeal. Auckland Council declined to comment on the Court of Appeal’s decision. A hearing date for the appeal has not yet been set, leaving the future of the Dome Valley landfill uncertain.
