CMA fines Wayfair, Appliances Direct and Gold's Gym for misleading sales

CMA fines Wayfair, Appliances Direct and Gold’s Gym for misleading sales

October 14, 2026 Priya Shah – Business Editor Business

Three companies have been hit with a combined £6 million in penalties by the Competition and Markets Authority for employing misleading sales practices as households struggle with high living costs. The enforcement action targets online furniture retailer Wayfair, electronics seller Appliances Direct, and Gold’s Gym for tactics ranging from false countdown timers to hidden membership fees.

Wayfair Penalised Over False Flash Deals

The Competition and Markets Authority fined online furniture retailer Wayfair £4.8 million for running false time-limited offers on its website, according to BBC reporting. Investigators found that products were advertised through daily deals and 24-hour flash sales alongside urgent messaging such as “Here Today, Gone Tomorrow” and active countdown timers. These elements created a false sense of urgency, implying that consumers needed to purchase immediately to secure the best price. However, the regulatory investigation revealed that many of these items remained available at the same price or lower after the stated deadlines expired.

A Wayfair spokeswoman addressed the penalty by stating that although the company believes the fine is excessive and disproportionate, it takes the findings seriously and chose to settle to maintain focus on customer service.

Appliances Direct Fined and Ordered to Refund Customers

Appliances Direct faces a £1.2 million penalty alongside orders to issue approximately £432,000 in customer refunds, as detailed in reports from GOV.UK. The electronics retailer used misleading time-limited discount codes that appeared repeatedly over many days despite pop-up banners claiming they were available for a limited duration. The investigation also uncovered that Appliances Direct automatically opted customers into paid-for extras such as old appliance removal, recycling, and installation services during checkout. Under consumer law, companies must secure express agreement before charging for optional add-ons, making pre-ticked checkboxes illegal. Thousands of affected buyers are slated to receive average payouts of £25.

Gold’s Gym Penalized for Unclear Membership Pricing

Gold’s Gym received a £45,000 fine and an order to distribute £9,220 in refunds after failing to disclose total membership costs transparently. The company is a UK franchise that operates four gyms in London. Regulators found that annual and Direct Debit memberships omitted the mandatory joining fee from the initial price display, or placed the total cost where it was unclear and unlikely to be seen by prospective members. A total of 726 customers will receive refunds of either £10 or £50 depending on their specific membership bought.

CMA Uses Enforcement Powers to Protect Households

Hayley Fletcher, senior director for consumer protection at the Competition and Markets Authority, emphasized that households managing tight budgets should not lose out due to misleading marketing. Over the past 18 months, the regulator has utilized its consumer protection enforcement powers to impose more than £12 million in fines and secure nearly £2.4 million in customer refunds. Under current regulatory frameworks, businesses that infringe consumer protection laws face penalties of up to 10% of their global turnover, or £300,000 where that figure is higher. All collected fines are transferred directly to HMT’s Consolidated Fund, while affected consumers for Appliances Direct and Gold’s Gym do not need to take any action as both firms contact them directly regarding compensation.
