Bengal Court Issues Arrest Warrant Against TMC MP Mahua Moitra in Hate Speech Case
A West Bengal court on Wednesday, August 19, 2026, issued an arrest warrant against Trinamool Congress Member of Parliament Mahua Moitra for failing to comply with court orders to appear in an alleged hate speech case.
Krishnanagar Bench Mandates Immediate Arrest
The 3rd judicial magistrate at the Krishnanagar Court ordered the immediate issuance of the arrest warrant after noting that Moitra repeatedly failed to appear despite summonses, according to reports by The Hindu. The bench directed that an execution report of the warrant be submitted by August 28, 2026.
The legal proceedings stem from a criminal complaint filed against Moitra within the Nadia district. According to top officials in the Krishnanagar police district cited by The Hindu, the complaint targets statements and remarks attributed to Moitra, invoking several provisions of Indian law.
Multiple Criminal Charges and Summon Failures
The charges include Section 79 for insulting modesty of woman, Section 196 for promoting enmity between groups, Section 299 for outraging religious feelings, Section 351 for criminal intimidation, and Section 353(2) for hate speech.

Pre-cognisance summons were initially issued by the court after the initial filing, directing Moitra to face the allegations in person. However, her failure to appear prompted the magistrate to escalate the matter.
Sharp Judicial Rebuke Over Defense Stance
In its August 19 order, the court expressed sharp frustration regarding the defense’s approach to the summons.
"The series of disobedience of the order of this court …. goes to show the lackadaisical approach of the accused to comply with the court order and accordingly, this court is left with no other option but to issue a warrant of arrest against her," the judge wrote, as documented by The Hindu.
During Tuesday’s hearing on August 18, the bench specifically instructed Moitra to appear the following day. Because she did not show up, her counsel stated to the bench that she would never attend proceedings at any time, maintaining that she has "No respect for the court of law", based on official judicial documentation. Furthermore, the lawyer for the MP conveyed apprehensions that Moitra might be heckled outside the court premises if she appeared.
Delhi Police Probe and Prior Political Fallout
The Nadia district warrant arrives as Moitra faces separate legal scrutiny regarding remarks made on social media.

According to reporting from PressVani, a separate case related to outraging the modesty of a woman was registered against the Trinamool Congress MP by the Intelligence Fusion and Strategic Operations (IFSO) unit of the Delhi Police Special Cell. That investigation centers on an online post directed at National Commission for Women chief Rekha Sharma following a stampede incident in Hathras.
Investigators from the Delhi Police Special Cell plan to obtain X handle details from the social media platform regarding the account used to publish the comments. Moitra won in this year’s general elections from West Bengal’s Krishnanagar with a margin of about 56,000 votes, following her disqualification from the Lok Sabha last year after the ‘cash-for-query’ row.
Law enforcement agencies in West Bengal are required to file the execution report concerning the Krishnanagar court’s arrest warrant by August 28, 2026.
