The Durban High Court adjourned the fraud trial of former mayor Zandile Gumede indefinitely on Monday after she reportedly fell ill during proceedings, prompting a traditional healing ceremony at her family’s home in KwaZulu-Natal. Gumede, who faces 17 counts of fraud and corruption linked to the city’s controversial R3.6 billion e-tolling system, was hospitalized briefly before the adjournment, according to court documents and legal sources familiar with the case.

Her legal team cited both her health and the need for a ukuthwala ceremony—a traditional Zulu ritual often performed to restore spiritual balance—as reasons for the delay. The ceremony, which involves elders and community leaders, was confirmed by Gumede’s family spokesperson, who stated that she would not return to court until the ritual was completed. The adjournment has reignited debates over the intersection of legal processes and cultural practices in South Africa’s justice system, particularly in cases involving high-profile political figures.

Gumede, who served as Durban’s mayor from 2016 to 2019, has been at the center of multiple corruption investigations since leaving office. The current trial stems from allegations that she and other officials misused public funds during the implementation of the e-tolling scheme, which was later scrapped amid public backlash. Prosecutors have argued that the system’s rollout—overseen by Gumede’s administration—was marred by irregularities, including inflated contracts and lack of transparency. The case is being heard in the same court where former president Jacob Zuma was acquitted of corruption charges in 2021, adding to its political sensitivity.

Meanwhile, Durban’s current mayor, Pieter van der Merwe, who took office in 2021, has distanced himself from the e-tolling controversy, stating in a recent interview that the city’s focus is now on economic recovery. Van der Merwe’s administration has avoided publicly addressing Gumede’s trial, though officials privately acknowledge the lingering reputational damage to Durban’s governance.

Cultural Ceremony

The adjournment comes as South Africa’s justice system grapples with a backlog of over 30,000 cases, many involving corruption linked to former government officials. The 2021 State Capture Commission report identified Durban’s municipal finances as a key area of concern, with findings that some contracts awarded under Gumede’s tenure lacked proper oversight. The trial’s outcome could set a precedent for how such cases are handled in courts where cultural and legal systems intersect.

Gumede’s legal team has not yet indicated when she will be fit to resume the trial, though court officials have set a tentative return date of October 14 pending further medical assessments. The NPA has not filed any objections to the adjournment, but prosecutors have signaled they will push for a swift resumption to avoid further delays.
