Vin Diesel sexual Battery Lawsuit Dismissed in California court
A lawsuit alleging sexual battery against actor Vin Diesel has been dismissed by a Los Angeles County Superior Court judge. The case, filed by former assistant Asta Jonasson in December 2023, was dismissed on Wednesday due to a legal technicality.
Jonasson’s lawsuit detailed an alleged sexual assault that occurred in 2010 during the filming of “fast Five” in Atlanta, Georgia. She claimed Diesel groped her, pinned her to a wall, and touched her without consent during an encounter in a hotel room. The complaint included ten claims, encompassing sexual battery, retaliation, and violations of California’s Fair Employment and Housing Act, and also named Diesel’s production company, One race Films, and its president, Samantha Vincent, as defendants.
Judge Daniel M. Crowley persistent that California was not the appropriate jurisdiction for the case, as the alleged incident took place in Georgia. He stated that California law could not be “applied to any of Plaintiff’s claims,” calling Jonasson’s argument “untenable” and conflicting with the state’s legal code.
The case had been scheduled to go to trial in February. Following the dismissal, Jonasson’s attorney, Matthew T. Hale, released a statement emphasizing that the court’s decision did not address the veracity of the allegations. “The ruling was based on a legal technicality,” Hale said. “We disagree with the ruling, and we are assessing next steps.”
Diesel’s attorney, Bryan Freedman, previously denied the allegations shortly after the lawsuit was filed, stating, “This is the first he has ever heard about this more than 13-year-old claim made by a purportedly nine-day employee. There is clear evidence which completely refutes these outlandish allegations.”
A legal representative for Diesel did not immediatly respond to a request for comment on Wednesday’s dismissal.
