Senator Chuck Grassley released documents Tuesday revealing that former Special Counsel Jack Smith’s team sought phone records from fourteen Republican lawmakers as part of the “Arctic Frost” investigation into alleged efforts to overturn the 2020 presidential election, escalating a dispute over the scope and methods of the probe.

The documents, released ahead of a Senate Judiciary Committee hearing on Tuesday, detailed a “wish list” created by Smith’s team identifying members of Congress whose “tolling data” – records of call detail, but not content – was desired. The lawmakers targeted included former Representatives Brian Babin, Mo Brooks, Jody Hice, and Louie Gohmert, as well as Representatives Andy Biggs and Paul Gosar, and Senators Mike Lee, Dan Sullivan, Marsha Blackburn, Bill Hagerty, Lindsey Graham, Ted Cruz, and former Representative Lee Zeldin. Grassley stated the records indicated Smith’s team already knew these members had communication with individuals associated with former President Donald Trump.

The release of the documents prompted immediate condemnation from Republican lawmakers, who allege the investigation represents an overreach of executive power and a politically motivated attempt to target political opponents. At a hearing on Tuesday, Senator Ted Cruz, presiding chair of the Senate Judiciary Committee, characterized Smith’s work as an “expansive scandal” involving the collection of personal information from hundreds of Republican entities and individuals.

Conservative critics, including Article III Project founder Mike Davis, have accused Smith of improperly coordinating with federal judges Howell and Boasberg, citing notes from a briefing Smith’s team gave to Attorney General Merrick Garland on January 13, 2023. These allegations center on meetings between Smith’s team and the judges during the Trump investigations, which conservatives claim suggest improper coordination in the cases against the former president.

Smith’s investigations resulted in criminal charges against Donald Trump related to the 2020 election and the alleged retention of classified documents. Trump has consistently labeled the investigations a “witch hunt,” and Republicans have widely condemned the charges as an abuse of power.

Former Special Counsel Jack Smith recently defended his prosecutions of President Donald Trump before the House Judiciary Committee, asserting they were lawful, apolitical, and based on evidence. A follow-up hearing before the Senate Judiciary Committee is scheduled for April 15, 2026, to further examine the documents released by Senator Grassley and the conduct of the Arctic Frost investigation.
