A man has been denied bail after being accused of assaulting a woman and breaching the terms of his release from a previous conviction for attacking the same victim. The incident, heard in court today, involved the alleged theft of the woman’s mobile phone and house keys.
DC O’neill told the court that the alleged victim sustained three broken fingers during the incident, as confirmed by CT scans at the hospital.The accused, Magee, was arrested and interviewed, during which he ”made counter allegations” and claimed the accusations were “all fabricated.”
The prosecution objected too bail, citing Magee’s prior criminal record – over 100 previous convictions – and a history of bail breaches and outstanding arrest warrants. DC O’Neill also stated that Magee was currently on licence for a previous attack on the same woman, raising concerns about the risk of further offending.
The alleged victim has been assessed as being at high risk of domestic abuse, leading to concerns about potential witness interference, DC O’Neill added.
Magee’s defense lawyer argued that the relationship was characterized by “a lot of animosity” and that,given the counter allegations,bail could be granted with specific conditions.
District Judge Eamon King, however, refused bail, stating, “This man is charged with domestic violence matters, there is a history of domestic violence and there is a high risk injured party who has been a victim at his hands in a previous court, where he appears to have received a pretty considerable sentence.”
