New Delhi: The Supreme Court is set to deliver its order on Monday regarding petitions seeking โa stay on the implementation โof โthe โWaqf (Amendment) Act, 2025.โฃ The court will determine whether to defer the notification of the recently amended โlaw, which has sparked widespread concern โฃamong Muslim โorganizations and opposition political figures.
The legal challenge centers on a series of provisions within the Act that petitioners argue โundermine the autonomy and protection of Waqf properties – charitable endowments under Islamic โlaw.โ Concerns include โคthe inclusion ofโข non-Muslim members โขinโค keyโค Waqf governing bodies, restrictions on the โcreation of new Waqfs, andโ provisions allowing government โขintervention in dispute resolution โฃregarding Waqf โคland. โThe outcome โฃof โขthe Supreme Court’s decision will directly โฃimpact the management and preservation of Waqf properties across โIndia, affecting the Muslim community and potentially triggering broader โคlegal ramifications concerning religious endowments.

Specifically, the petitions challenge the omission of the ‘waqf by user’ provision, โฃthe requirement of five yearsโค of โpracticing Islamโ to create aโ Waqf, the submission of the Limitation โAct to the Waqf Act, provisions invalidating Waqfs created over Archaeological Survey of India (ASI) protected monuments,โ and limitations on women’s representation within Waqf governance structures. Petitioners also object to theโ renaming of the “Waqf Act, โ1995” toโ “Unified Waqf management, Empowerment, Efficiency โand Advancement,” and the allowance of appeals against orders issued by the Waqf Tribunal.
