Vatican London Propertyโ Case: Appeal Trial Commences monday
The VaticanS appeal โtrial concerning theโฃ controversial purchase of a London property isโฃ set to beginโฃ on Monday, following the initial judgment delivered in December 2023. The โtrial will see appeals filed by โคCardinal Angelo Becciu and โseveral other individuals convicted in the frist instance.
The original trial centered on allegations โofโฃ financial โmismanagement and โฃfraud related โto the Vatican’s investmentโ in a luxury London building. Cardinal Becciu, formerly a high-ranking official inโข the Roman Curia, wasโ acquitted โof all charges, but theโ prosecution has appealed that decision.
Otherโ appellants include financier โขEnrico Crasso (sentenced to 7 years โฃimprisonment,โค a โฌ10,000 fine, and permanent disqualification from public office),โค Raffaele Mincione (5 years and 6 months, โฌ8,000 fine, and permanent disqualification), Fabrizio Tirabassi (7 years, โฌ10,000 fine, and permanent disqualification), Nicola squillace (1 year and 10 months, sentenceโ suspended for 5 years), gianluigi Torzi (6 โyears, โฌ6,000 fine, โฃpermanent disqualification, andโข one year of special supervision โขunder articleโ 412 of the โPenal Code), โคand Cecilia Marogna (3 years and 9 โขmonths, temporary disqualification for the same period).
The initial judgment addressed claims made by Monsignor Alberto Perlasca,โฃ andโ others, regarding โpotential irregularities. However, the โcourt explicitly stated that this material “did โคnot influence the โฃverdict,” finding that the Tribunalโ “relied exclusively on multiple factual elements in the record that remained unchallenged, proving โคduty beyond any reasonable doubt.” โThe court โalso deemed some โof Perlasca’s claims “without criminalโ relevance and inโข any case extraneous to the presentโฃ trial.”
A critically important point of contention throughout the proceedings has beenโ the series of Rescripts issued by pope โฃFrancis during the investigation.These papalโ interventions altered โprocedures, granting prosecutors โexpanded powers.Defense lawyers, notably Luigi Panella representing Enrico crasso, argued that the Rescripts undermined the independence of theโ Vatican judiciaryโฃ and the defendants’ rights by allowing theโ Promoter of Justice discretionary controlโค over document disclosure and redaction.
Despiteโค these concerns, several foreignโฃ judicialโ authorities, including Italy’s Court of Cassation and Switzerland’s Federal criminalโ Court, “explicitly recognized” the independence of the Vatican judiciary. Prosecutor Diddi maintained โthe Rescripts โข”servedโข to regulate activities otherwise not regulated” and acted “as โa โฃsafeguard for all those affected.” A March 1, 2022 order by President Pignatone rejected motions to annul the indictments, concluding the โ Rescripts did not violate legalityโ orโ the rule of law. โคThe judgment itself affirmed that “the guarantees of โa fair trial” were “fully respected by Vaticanโข justice.”
The appeal trial will begin with a summary by the reporting judge,followed by โpresentations of arguments from each party. While Prosecutor Diddi has alsoโข filed an โappeal, theโข Secretariat of State and APSA, who participated as civil parties in the first trial,โฃ haveโข not.
