EMRA Updates Regulations forโฃ Unlicensed Electricity Generation
the Energy Market Regulatory Authority (EMRA) has implemented newโ regulations concerning theโ transfer and connectionโ of unlicensed electricity generation facilities, โas published in the Official Gazette.โข These amendments to the Unlicensed Electricity Generation โฃregulation impact โhow facilitiesโ canโฃ be transferred and connected to the electricity grid.
Generally, facilities subjectโ to transfer (excluding cases of inheritance orโ bankruptcy) โฃare prohibited from re-applying โfor a new consumption facility association. Any connection โagreement requests for aโ new consumption facility โคlinked to โขa transferred generationโ facility will not be evaluated,unless the production facility and its โขassociated consumption facility are transferred โฃto the same entity,or between publicโฃ institutions.
Transfers occurring within the same month must be reported to the market operator by the 15th ofโข that month,who will then inform the relevant network operators.
Forโข wind โand solar โenergy facilities, connection priorityโ will be โขdetermined based on several factors โคwhen โขa call โคletter hasn’t previously been issued.โค these โฃfactors, in orderโฃ of โimportance, โare: high โannual consumption, strong contract terms, and a โlack ofโ prior positive connection opinion.
Changes to a consumption facility must maintain or increase capacity. The contract power and annual consumption โคof any new facility โmust โbeโฃ equal to or greater than the current production capacity. If โthese requirements aren’t met, excess energy generated will โnot be โฃcompensatedโฃ and will instead be considered a voluntary contribution โฃto the โฃRenewable Energy Resources โSupport Mechanism (YEKDEM).
When evaluating new applications, previously allocated production capacity for theโ same consumption facility will be deducted โfrom the currentโค request. Furthermore, excess energy โcan be sold through energyโ aggregators. The market operator will implement aโ system, effective December 15th, to track data related to these transfers and connection priorityโฃ evaluations.
