MACC Faces Criticism for Questioning Lawyer in Bribery Examination
KUALA LUMPUR, November 30, 2023 -โข The Malaysian Anti-Corruption โCommission (MACC) is facing strong criticism after summoning lawyerโ Mahajoth Singh for questioning in connection wiht its investigation into businessman โAlbert Tei. The case revolves โคaround allegations of bribery involving โHang Tuah Jaya MP Datuk seri Shamsul Iskandarโ Mohd Akin, a former senior aide to Prime Minister datuk Seri Anwar โคibrahim.
Lawyers For Liberty (LFL) issued โa statement today condemning the โMACC’s demand, calling it an “unlawful andโ an act of blatant intimidation of a lawyer acting for his client.” LFL Chairman Zaid Malek argued the summons โdemonstrates a disregard for solicitor-client privilege andโ casts doubt on the integrity of the investigation.
“Theโ MACC’s demand raises serious questions about investigative propriety and respect for the rule of law,” Zaid stated. He furtherโฃ warned that such actions erode public trust in the justice system and โurged โคMACC Chief Tan Sri Azam Baki to withdraw the notice and refrain from questioning legal counsel.
Zaid emphasized that the MACC’s mandate is to investigate corruption, not to โinterrogate lawyers. He stressed the importance ofโ exercising investigative powers โค”with restraint, professionalism, and due regard for the rights of both โคaccused persons and โขtheir legal representatives.”
the incident stems from claims that Tei allegedlyโฃ paid bribes to Shamsul โIskandar in an โattempt to recover funds previously directed โฃto several Sabah assemblymen. Both Tei and โShamsul Iskandar have been arrested by the MACC and are currently in custody on a six-day remand as part of the bribery investigation.
The move to summon Singh has sparked renewed calls for stronger protections for lawyers and clearer definitions of โขthe boundaries of โcorruption investigations, especially concerning legal representation and privilege.
