Concanaco supports judicial reform; perceives a lot of corruption

Mexico City. The majority of members of the Confederation of National Chambers of Commerce, Services and Tourism (Concanaco-Servytur) are in favor of the reform of the Judicial Branch as proposed by President Andrés Manuel López Obrador, because there is a lot of corruption, reveals a survey carried out among members of the oldest business organization in the country.

“The majority, according to the survey, establishes that a reform of the Judiciary should be carried out and also confirms the fact that the feeling, because it is a perception, is that the Judiciary does have a high rate of corruption and we are talking about more than 70 percent,” said Octavio de la Torre de Stéffano, leader of Concanaco Servytur, in a press conference.

According to a survey conducted in recent days by an external consulting firm, 52 percent of union members agree that the Congress of the Union should make changes to the judicial system, while 48 percent disagree.

Although 6 out of 10 owners of commercial and service establishments trust the government of President López Obrador in the management of the reform that legislators will discuss in September, the level of trust is higher (7 out of 10) for the same issue in the administration of the president-elect, Claudia Sheinbaum Pardo.

With this, Concanaco – which represents the sector that accounts for two thirds of the economy – is positioned as the first private sector organization to support the initiative, although De la Torre de Stéffano noted that the judges chosen must be people trained in their areas.

According to the survey, business owners in tertiary activities also believe that it is necessary for the judiciary to have a body in charge of supervising judges.

The Concanaco leader commented that although his members perceive “a lot of corruption”, there is confusion in believing that the attorneys general or those of the states or the public ministries are part of the Judicial Branch.

Without affectations

Regarding the depreciation of the peso against the dollar that has been observed since last June, De la Torre de Stéffano minimized the impact, as he considered that the Mexican economy is strengthened and the rating agencies’ claims have not come true, since even investment intentions have not been affected by this situation.

“It is a reality that is reaching investment. I see it with our Development and Investment Center that we have in Concanaco-Servytur, where people from Uruguay, Singapore, and China have come with the intention of investing in Mexico and of making investment letters of intent in different states of the Republic,” he said.

On the other hand, he acknowledged that the appreciation of the dollar generates benefits for a segment of the economy, in particular, for all export products, since it generates a direct benefit for all companies that are part of the maquiladora industry, export service manufacturing and those that provide services or sell products for export.

However, he also noted that for importers the observed level of the exchange rate represents a marginal increase in the products consumed by households.

Although he did not offer an estimate, he considered that with the entry of the government of President Sheinbaum Pardo, the peso will appreciate at the end of the year.

The Plenary Session of the Judiciary is not suspended

Mexico City. Judge María de Lourdes Lozano Mendoza informed the workers who are demonstrating at the Federal Judiciary headquarters of the decision not to suspend the plenary session for today, pointing out that the organization has to resolve operational issues.

“A moment ago, the Plenary of the Judiciary took note of this protest, the honourable men and women councillors considered suspending the session, if this was possible, in solidarity with this protest.

“However, as we all know, the matters resolved by the Plenary Session of the Judiciary relate to the operation of the body itself, of all the jurisdictional bodies. We have matters of retirement, sick leave, we have substitutions in jurisdictional bodies. These are activities that cannot be suspended, taking into consideration that this may paralyze the activities of some jurisdictional body.

“This is a suspension of activities, however, urgent matters cannot be paralyzed because this would seriously affect society, for this reason it was decided to continue with the session to deal with all these matters of an operational nature, however, they are aware of the protest and they asked me to inform everyone that for this reason the session continues,” said Judge Lozano Mendoza.

Mexico to send diplomatic letter to Canada over allegations of judicial reform

Deputies prepare a judicial reform bill with more than 100 changes

Mexico City. The House of Representatives’ Constitutional Affairs Committee has already prepared the draft opinion on judicial reform, which includes more than 100 changes to President Andrés Manuel López Obrador’s initiative on the matter.

Among the key changes is that the election by popular vote of the nine ministers who will henceforth make up the Supreme Court will be carried out entirely in an extraordinary electoral process in 2025, but in the case of judges and magistrates there will be a gradual process.

Half of the latter, some 800 positions, will be up for election in the extraordinary election of 2025, which will include vacant positions and early retirements, and in 2027, in an ordinary election, 50 percent of judges and magistrates will be elected.

The minister who has obtained the highest number of votes will be president of the Supreme Court.

The coordinators of Morena, PT and PVEM in the Chamber of Deputies, Ignacio Mier, Reginaldo Salazar and Carlos Alberto Puente, accompanied by the president of the Constitutional Affairs Committee, Juan Ramiro Robledo, made the announcement and specified that the draft opinion will be made public this afternoon and there will be a period of 10 days for the parties to analyze it.

The intention, they stressed, is to vote in that commission within two weeks.

The Morena coordinator, Ignacio Mier, highlighted that 60 percent of the changes to the presidential initiative were made based on contributions that arose during the discussion forums of the reform in which different instances of the judicial branch participated, specifically 66 people.

He said that the draft ruling also includes changes that address concerns about the criteria for selecting judges. The new draft establishes that judges, magistrates and ministers who decide to participate in the election process may participate without any evaluation requirements.

For candidates who are running for office for the first time, there will be evaluation bodies in each of the branches of government, that is, in the Supreme Court, the Senate and the Chamber of Deputies. In the event that there is a greater number of candidates than planned, a drawing of lots will be held, giving preference to women.

Those with the highest scores will be chosen, and in the event of a tie, a raffle will be used, in a transparent process, not like before when friends and cronies were favored, Mier said. He insisted that there will not be a “blank check.”

In this regard, the president of the Constitutional Affairs Committee, Juan Ramiro Robledo, explained that the changes in this draft opinion include a series of mechanisms that ensure

“that the best Mexicans, men and women, will be working in an open and highly democratized judiciary from now on.”

He specified that judges, magistrates and ministers who are elected will undergo two evaluations. One before participating – from which current judges will be exempt – and another one year after taking office. “The disciplinary court will replace the Judicial Council, will review their management, will put them to work to train themselves more and if they do not improve, they will be removed.

Current judges and magistrates, he stressed, may even compete for promotion, becoming magistrates or ministers.

Deputy Mier also stated that the tenth transitory article clearly establishes that the acquired rights of the workers of the judiciary will not be violated, nor will their retirement benefits, which are included in two trust funds for health and supplements to their benefits and salaries.

The draft ruling, he said, guarantees the people of Mexico the ability to access justice in a prompt, expeditious and free manner.

Ready, judicial reform opinion with 100 changes

The Constitutional Affairs Committee of the Chamber of Deputies presented last night the draft opinion of the judicial reform, which includes more than 100 changes to the initiative of President Andrés Manuel López Obrador, the most relevant regarding the election by popular vote of judges, magistrates and ministers, which will be gradual in the case of the former and with staggered periods in the case of the members of the Supreme Court of Justice of the Nation.

The reduction of the number of ministers from 11 to nine, as proposed by the Executive, will be maintained, and the new judges will be elected in an extraordinary election, organized by the National Electoral Institute on the first Sunday of June 2025, for periods of eight, 11 and 14 years. In the contest, five will be women and the president of the Supreme Court will obtain the largest number of votes.

Regarding the positions of judges and magistrates, only half of them, about 800, will be put to the ballot in this extraordinary election in 2025, and vacancies and early retirements will be included. In 2027, in an ordinary election, the remaining 50 percent of judges and magistrates will be selected by citizens, also under gender equality.

The five current members of the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation will remain in office until the 2027 election, when the new magistrates will be selected for six years. The current ones will not participate and those from regional chambers will be elected in 2025.

The coordinators of Morena, PT and PVEM in the Chamber of Deputies, Ignacio Mier, Reginaldo Salazar and Carlos Alberto Puente, accompanied by the president of the Constitutional Affairs Committee, Juan Ramiro Robledo, made the announcement and specified that the draft opinion will be under discussion in the coming days and will be voted on in San Lázaro in two weeks.

Contribution from discussion forums

Ignacio Mier stressed that 60 percent of the changes to the presidential initiative were made based on contributions that arose during the forums for discussion of the reform, in which different bodies of the Judiciary participated, specifically 66 people.

He said that the draft ruling also includes changes that address concerns about the criteria for selecting judges. The new draft establishes that judges, magistrates and ministers who decide to participate in the election process may participate without any evaluation requirements.

For candidates who are applying for the first time, there will be evaluation committees in each of the branches of government, that is, in the Executive, the Supreme Court and Congress, which will verify that they meet the requirements for experience, track record, integrity and good name.

Deputy Mier specified that in the event that a greater number of candidates than planned is presented –30 in the case of ministers–, those who obtain the highest scores will be selected and in the event of a tie, a draw will be made, giving preference to women. It will be, he said, a transparent process, without influence, in which judges will compete for a promotion –going from judge to magistrate– and secretaries, who are those who do the work in the courts.

In this regard, Juan Ramiro Robledo explained that judges, magistrates and ministers who are elected will undergo two evaluations. One before participating – from which current judges will be exempt – and another one year after taking office, which could remove them if they perform poorly.

Deputy Mier also stated that the tenth transitory article clearly establishes that the acquired rights of the workers of the Judicial Branch, nor their retirement benefits, included in two trust funds for health and supplements to their benefits and salaries, will not be violated.

The draft opinion establishes that the Judicial Council will continue to exercise its powers and attributions of surveillance and discipline while the disciplinary court and the judicial administration body are created.

CJF prepares new day of analysis for the reform of the Judicial Branch

Mexico City. The Federal School of Judicial Training (EFFJ) will hold the National Conference “The Reform of the Judicial Branch in the Voice of the Judiciary”, with the aim of creating a space for reflection and analysis on the central themes of the initiative to reform the Judicial Branch.

The Federal Judicial Council (CJF) reported that the sessions will be held on August 12, 14 and 16 at the headquarters of the Houses of Legal Culture of the Supreme Court of Justice of the Nation (SCJN) and/or in the Regional Extensions of the Federal School of Judicial Training throughout the country.

The CJF pointed out that in this way, it is guaranteed that in the 32 jurisdictional circuits of the country they will simultaneously access the work of the tables and workshops in which different topics around the reform will be addressed. It added that in person or telematically, the judges of the PJF and of the local judicial powers, as well as their jurisdictional and administrative staff, members of Bars and Bar Associations, representatives of the academy and civil society organizations at the national and international level, will be able to participate in this activity.
