MC denounces arrest of opposition senator Daniel Barreda – El Financiero

by Chief editor of world-today-news.com September 11, 2024
written by Chief editor of world-today-news.com

Former presidential candidate Jorge Álvarez Máynez publicly denounced on social media that Daniel Barreda Puga, father of Movimiento Ciudadano (MC) senator Daniel Barreda Pavón, was arrested. In the ordinary session of this Tuesday in the Senate, Senator José Clemente Castañeda also pointed out the arrest as a pressure measure, in the midst of the upcoming discussion of the reform of the Judicial Branch.

Senator Barreda Pavón’s vote is decisive for the debate in the Senate this Tuesday, when the reform of the Judicial Branch is planned to be voted on, said Máynez.

At the Senate session this morning, José Clemente Castañeda, a senator from the MC, said that both the senator and his father were arrested.

“We also have information that our colleague Senator Daniel Barreda has been detained by the governor of Campeche, Layda Sansores (…) Therefore, from Movimiento Ciudadano we demand that (Gerardo Fernández Noroña, president of the Senate Board of Directors) pause the session until we have full assurance that our colleague Senator Daniel Barreda is free,” Castañeda said.

Did Adan Augusto deny the arrest of MC Senator Daniel Barrera?

However, the information about the arrest of Senator Daniel Barrera and his father has been denied by Morena. Adán Augusto López, who is the coordinator of the Morena Party in the Senate, said that the Morena supporters are also concerned and worried about the senator’s absence and pointed out that the Morena governor, Layda Sansores, was available to review the files and rule out the alleged arrest of the MC senator and his father.

Furthermore, the senator and president of the Board of Directors, Noroña, has refused to consider a recess of the session until Barreda’s whereabouts are known.

In the Senate, Morena hopes that the first reading of the reform to the Judicial Branch can be given today, which has been strongly criticized by opposition legislators, but has also received criticism from the US ambassador to Mexico, Ken Salazar, and other authorities, as well as from business organizations.

Meanwhile, PAN Senator Ricardo Anaya sent his “absolute solidarity” to Movimiento Ciudadano.

At noon, Fernández Noroña said that he had already had communication with Senator Daniel Barreda and that he had assured him that he was fine, along with his father.

“He told me they were in Mexico City,” and neither of them were arrested, Noroña said.

What did Layda Sansores say about the arrest of the MC senator in Campeche?

Campeche Governor Layda Sansores said it was “absolutely false” that Senator Daniel Barreda Pavón and his father were detained.

“Mr. Jorge Álvarez Máynez is irresponsible for having started this rumor without any basis,” he said on social media.

Senator Daniel Barreda Pavón and his father Daniel Barreda Puga held municipal positions during the municipal presidency of Campeche, also of the MC member Eliseo Fernández Montúfar who is a fugitive from justice and has been disqualified from holding public office for 20 years.

What did Senator Daniel Barreda say about judicial reform?

The senator of the Citizen Movement, Daniel Barreda Pavón, recently expressed his position regarding the judicial reform proposed by the ruling party Morena, which has been criticized by opposition groups such as the PAN, PRI and MC.

On September 5, Barreda stressed that he is interested in reforming the judicial system in Campeche, because “for two and a half years we have experienced political persecution” in the state, he said.

“Of course we need a reform, but we have to read it, we have to study it. It’s not just a matter of voting against it because some people are proposing it, or in favor because others are proposing it. I want to tell you that after having studied it and having read it (the judicial reform), my vote will be totally against it,” he said.

I want to share my position on the Judicial Reform, as well as denounce the abuses we have suffered in Campeche by the government of Layda Sansores.

MY VOTE IS AGAINST this reform that threatens the impartiality of justice and violates human rights. pic.twitter.com/UmP7Sa2Lze

Migrant deputies express support for reform of the PJF

by Chief editor of world-today-news.com September 11, 2024
written by Chief editor of world-today-news.com

Mexico City., A group of migrant deputies from Morena expressed their support for the reform of the Judicial Branch of the Federation (PJF) – which was already approved in San Lázaro and could begin to be discussed this Sunday in the Senate of the Republic – by stating that only through this means will it be possible to end corruption, nepotism, impunity and other vices that afflict this area.

In a “manifesto to public opinion,” federal deputies Aniceto Polanco Morales (who identified himself as “coordinator of the migrant bench” and is a resident of Los Angeles, California), Olga Leticia Chávez Rojas (Los Angeles), Maribel Solache, Nadia Sepúlveda (both from San Diego, California) and Roselia Suárez Montes de Oca (Chicago, Illinois), stated that the reform “is an unavoidable necessity” due to the various irregularities existing in the PJF.

The Judiciary, they said, “is a sclerotic branch of the state, atrophied by corruption and deviations. […] It is a body in a state of terminal decomposition that must be replaced by one that acts at the height of the need of this time of change that the nation requires to put an end to a legal framework that served as support for neoliberal governments to serve their allies, the owners of national and foreign capital.

After highlighting the role of President Andrés Manuel López Obrador in the transformation of institutions, the migrant deputies stressed that last Wednesday they voted “out of conviction for the reform of the Judicial Branch by a qualified majority,” with the aim of making justice accessible to all citizens.

“We must all be equal before the law. No more a judiciary that assumes justice as a commodity that is given to the powerful. No more a judiciary with nepotism, with incomes higher than those of the President, because they violate the Constitution. No more protection for those who refuse to pay taxes, for people or companies who amass fortunes by violating the law,” they stressed in their manifesto.

The signatories considered that the election of judges, ministers and magistrates by popular vote will give “legal certainty” to the PJF, while they disqualified the opposition parties that reject the reform.

“Given the imminent legislative green light for constitutional reforms, a reaction has been unleashed by the opposition who will not change our decision taken in compliance with the popular will,” they emphasized.

Judicial reform: good or bad?

by Chief editor of world-today-news.com September 9, 2024
written by Chief editor of world-today-news.com

He Senate of the Republic The process to approve the bill began this Sunday judicial reform without any modification to prevent its return to the Lower Houseso, with 25 votes in favor and 12 againstwas endorsed in commissions.

Las Joint Committees on Constitutional Matters and Legislative Studies in it Senate They began the analysis and voting of the minutes approved by the Chamber of Deputies about the reform of the judiciary which, since September 4, has become a central topic of discussion, but are we really measuring the situation? To what extent does the reform benefit or harm the country?

The reform has been criticized even by the press at an international level, as has been done by the Washington Posthe New York Times, Reutersamong other media outlets, who agree that if the reform is approved and not implemented properly, Mexico will lose its remaining legalitywhile also foreign investment will decrease.

There is something that we as Mexicans should recognize, and that is that, indeed, the judicial system It has not been renovated in many years, which has caused it to be a constant focus of corruption and impunityat least from the perception of those who have faced judicial proceedings.

But what the proposal is judicial reform of the still president Andres Manuel Lopez Obradorit seems that it will not attack the underlying problem either, that is, the prosecutors of each state, since it is focusing on the federal level and does not specify, in a clear and concrete way, how the reform would benefit the Judiciary a nivel local.

From there, this reform is denoted merely political by trying to reduce the power of the Supreme Courtwhich was the one that hindered Lopez Obrador in several of his reforms, which was also the main reason that alienated Norma Lucia Pineapple with the head of the federal Executive.

To this accumulation of uncertainty about what will happen once it is approved in the Upper Housewhich is almost a fact, since the 4T only needs one vote to gather the qualified majority, it must be added that the majority of Mexicans We do not know the function of the three Powers of the Union In general, but the judicial one is the most ignored, so getting involved in the pros and cons seems to have no major relevance, although it should have.

The importance of this reform is indisputable, since we are not only talking about elect judges and magistrates by popular voteor that they earn less than the president, but also that the identity of the judges can be hidden in cases considered serious, such as those involving organized crime. I repeat, the issue is not minor and sadly it is people of other nationalities who are taking the matter more seriously.

One of the motivations of Andres Manuel Lopez Obrador to carry out this reform is that Justice in Mexico It is not prompt or expeditious, and we all agree on that, however, many of us are not clear on how and why the methodology of the popular vote for the Judiciary will promote the administration of justice.

The final vote will probably be on Wednesday, September 11th. Senateif approved, we will see if transparency and accountability, democracy and the reduction of corruption end or, at least, diminish, the least we expect is to have a politicized justice system in which, once again, personal interests are the guiding axis of politics in Mexico.

ICC calls for caution in approving reform to the Judicial Branch

by Chief editor of world-today-news.com September 9, 2024
written by Chief editor of world-today-news.com

Mexico City. The International Chamber of Commerce Global and its Mexico chapter asked the Congress of the Union to “act with caution” regarding the initiative to reform the Judicial Branch that is being discussed by legislators, since they consider that its approval puts foreign investment in the national territory at risk, particularly in the context of the relocation of companies.

The global organization, which represents more than 45 million companies in more than 170 countries and has had a representation in the country since 1945, commented that the nation “as a sovereign State has assumed international commitments that oblige it to maintain an independent and impartial judicial system, which allows for a rule of law that provides legal certainty, a crucial element to attract and retain foreign investments.”

However, he noted that the initiative, as drafted, “could jeopardize the independence and impartiality of the Mexican courts, which would have serious consequences for national and foreign investment and, ultimately, for the country’s economy and the Mexican people.”

“The legal uncertainty that could arise from a politicization of the Judiciary would not only affect the confidence of investors, but would also create a context that could trigger international arbitrations against the Mexican State,” he warned.

Both ICC Global and ICC Mexico urged the Congress of the Union to consider the recommendations issued by the UN special human rights inspector, Margaret Satterthwaite, in April 2024; to observe international experiences in the protection of foreign investment, in order to prevent the risks of international law from increasing and leading to economic condemnations for the nation.

“Mexico is experiencing a key moment with the phenomenon of nearshoringwhich presents a historic opportunity to attract global investments, a situation that could be compromised if the stability and legal certainty necessary for investors are not guaranteed,” he insisted.

The international organization called for caution in approving the ruling, as it considered that the wording of the reform, which proposes the popular election of judges, magistrates and ministers, “generates negative incentives that could lead to the politicization of their function or the interference of third parties.”

He pointed out that the broad powers that the Disciplinary Court would have “generate legal uncertainty” and the risk that the judges will not act according to their own free judgment when resolving cases.

The ICC commented that in recent years the Judiciary has been a counterweight, which has prevented decisions by other branches from affecting national and foreign investment, in addition to preventing numerous investor-state arbitrations that sought to result in “multi-million dollar sentences against Mexico.”

The international organization and its chapter in the country indicated that the reforms should allow the attraction and growth of investments.

We will transform the Judiciary, says PT bench

by Chief editor of world-today-news.com September 7, 2024
written by Chief editor of world-today-news.com

Mexico City. The Labor Party (PT) said that in the six-year term that is about to end, the Executive and Legislative Powers have been transformed, “and the one that is still missing, but we are going to transform it, is the Judicial Power, without a doubt. The people of Mexico mandated us to transform the nation.”

During the session of the General Congress that kicked off the LXVI Legislature, and in which moments before the last report of the federal government was delivered by the Ministry of the Interior, federal deputy Reginaldo Sandoval Flores stated that “in the neoliberal period, with 135 decrees, our Constitution was reformed 495 times. None in favor of the people, all in favor of the oligarchy.”

At the same time, during the current six-year term, 63 articles have been amended with 24 decrees. “Therefore, without a doubt we are going to reform the Constitution to change the Judicial Power, put it at the service of the people, put an end to the last bastion that the right and the oligarchy have in the Supreme Court of Justice of the Nation, which is not a court of justice, it is a court of corruption, and that is why we are going to transform it without a doubt,” he added.

As part of the PT’s position regarding the presidential report, it said that the “overrepresented” parties in the Congress of the Union are those of the opposition.

Following the opposition’s complaints about the composition of the Chambers of Deputies, he argued that the coalition Let’s Keep Making History obtained 256 of the 300 electoral districts, which represents, he said, 85 percent of the national territory and this coalition won 30 states in the Senate formulas.

While “of the 2,477 municipalities in this country, the coalition Let’s Keep Making History only lost in 125, to give you an idea. Of the 32 entities, we won 31, the only loss was in Aguascalientes. And yet you still come to say that we have no legitimacy, that we are overrepresented. No, you are the ones who are overrepresented.”

In defending the policy of the administration that is about to end, Sandoval asserted that the opposition’s positions reflect the two visions of the nation, and “it saddens me that at this point they still have a wrong diagnosis and want to continue on the same path that the people have them on now.”

After considering this a historic day for the beginning of the second stage of the 4T, he told the opposition that “we need them to change, to learn, to listen to the people so that they can have a political future in this nation. If not, they will suffer the same fate as the PRD. We want them to defend themselves and assert what they really represent.”

He also claimed that the PT supported López Obrador since he ran for the position of Head of Government in 2000. “Thanks to the PT votes he was Head of Government because if not, Creel would have won.” While after 2006, he pointed out that the PT never met institutionally with Felipe Calderón, since they did not recognize him as president.

Regarding the 2012 elections, he considered that it was that year when “the high treason of the PRD and its leadership occurred.” He then asked: “Where is the PRD now?”

Morena pauses request for impeachment of judges

by Chief editor of world-today-news.com September 4, 2024
written by Chief editor of world-today-news.com

Mexico City. Morena in the Chamber of Deputies decided to freeze the impeachment request that a group of legislators filed against judges Martha Eugenia Magaña López and Felipe V. Consuelo Soto. The coordinator of the bench, Ricardo Monreal Ávila, said that he asked his colleagues to “pause” that process.

Last night, at the conclusion of the regular session, Morena deputies, headed by Sergio Gutiérrez Luna, announced that they also filed a criminal complaint and a complaint before the Federal Judicial Council against both judges, for allegedly exceeding their powers and functions and violating the principle of legality, by granting a provisional suspension to try to stop the discussion of the reform of the Judicial Branch of the Federation.

In a press conference, in the context of the plenary meeting of the group, Monreal stressed that at this time “prudence and tolerance help the country.” The deputy did not confirm that the impeachment request had been submitted, but clarified that, if it had been, “it must be put on hold.”

In response to a direct question, Monreal insisted that there is a thesis from the Supreme Court of Justice of the Nation which provides that, in reforms to the Constitution and the acts that derive from them, the amparo trial is inadmissible.

In the context of the complaint by Morena deputies, it was reported that thesis 55/2004 defined that political trial does not apply to legal resolutions of state judicial powers.
However, Monreal pointed out that “all authorities are subject to the principle of legality and cannot do anything that is not permitted by law,” and, therefore, the suspension granted by the two judges is not permitted by law.

Both, he said, “violated the principle of legality.”

Monreal even attributed to Magaña López and Consuelo Soto granting the suspension as part of a political strategy. “They know that it was a huge mistake,” that they violated the Constitution and the principle of legality. In Morena “we do not accept this type of perversity,” he said.
