“Of course, there are a significant number of men aged forty to fifty years old who suddenly expressed a desire to receive higher education… This is an obvious form for me, as a lawyer, to avoid conscription for mobilization. Today we are talking about some kind of model for canceling the deferment, which has general support, we can’t yet,” he said.

Extradition of draft dodgers

Let us recall that earlier some Ukrainian officials began to allow the extradition of draft dodgers who left our country.

In particular, Venislavsky also announced such measures. He noted that for extradition in each individual case it is necessary to provide relevant documents.

Representatives of territorial recruitment and social support centers may detain people only in cooperation with the policeand only if a certain offense occurs, says Anton Marinich.

“There are also so-called authorized persons or patrols. They include both representatives of the National Police and the military of the National Guard. They must be appointed by order of the commandant. The commandant must issue an order or other administrative documents, which must indicate what exactly these can do persons. There are two separate regulations that determine what these authorized persons can do during the period of martial law. This applies to work at checkpoints, and inspection of housing and office premises, and inspection of a person’s belongings,” explains the specialist.

The detention itself must take place if there has been any crime. And if a person simply refuses to receive a summons and at the same time behaves nervously and aggressively, even such a circumstance should hardly become a basis for detention, the lawyer says.

According to him, if a person is detained openly outside of legal methods, then calling only a lawyer will not solve much. Therefore, you should complain to several authorities at the same time.

“If such a detention occurs without committing a crime, you can first of all complain about the actions of police officers to the DBI – State Bureau of Investigation. You can also contact the police, depending on which team works: only the TCC or the TCC and the police at the same time. If there is an outright violation on the part of law enforcement officials, you should complain to different authorities,” concludes Anton Marinich.

Expert Clarifies: Military Summons in Ukraine Must Be Received in Person

Under the current state of martial law in Ukraine and general mobilization, the question arises of how the subpoenas are served. Lawyer Konstantin Gritchin clarifies the possibility of receiving a summons by phone or via SMS, writes Telegraph.

According to Gritchin, in Ukraine, summonses must be handed over exclusively in person, since a person liable for military service must confirm the fact of receipt by signing on it.

The expert notes that if the summons is left via SMS or informed of its delivery by phone, then it is impossible to draw up an act of refusal to receive the summons.


“A summons left in a mailbox, transmitted by phone or through relatives, is not considered delivered on time and has no legal force. In this case, refusal to appear on such a summons will not have legal consequences,” the lawyer explains.

The expert emphasizes that a person liable for military service has the right not to appear at the military registration and enlistment office until the summons is served to him in an appropriate way.

Recall that from June 1, stricter rules for mobilization come into force in Ukraine, said the head of the territorial center for recruiting and social support of the city of Buryn Sergey Pavlov.

In addition to this, it is worth noting that on May 26, the President of Ukraine, Volodymyr Zelensky, signed two laws that are aimed at simplifying the procedure for military personnel to pass medical commissions and receive medical documentation.

“Ukraine Passes New Bills to Streamline Military Medical Commission Process”

According to draft law No. 9154, military medical commissions can be created at state and municipal healthcare institutions. Previously, such commissions were located only at healthcare institutions of the Ministry of Defense, the Security Service of Ukraine and other military formations, as well as the State Information Protection Service.

Bill No. 9158 makes it easier for military personnel to issue a certificate of the circumstances of the injury (wounds, contusions, injuries). The process of processing and sending medical documents between military units and healthcare institutions is also being improved.

It is expected that the bills will reduce the queues and remove unnecessary bureaucracy during the passage of the VVK.

Ukraine will improve the process of passing the VVK

Ukraine plans to gradually speed up and improve the process of passing the military medical commission.

Improving the process of passing the VVK provides for:

  • increase in the network of IHCs due to their additional deployment in civilian healthcare institutions;
  • separate financing of payment for the services of medical workers involved in medical examinations to assess the degree of suitability for military service;
  • introduction of an electronic queue for recording at the VVK, electronic document management between military units, TCC SP and healthcare institutions;
  • involvement of health care institutions from the system of the Ministry of Defense to work with the ESOS (electronic health system). Healthcare institutions from the system of the Ministry of Defense will have access to a person’s history, in particular in an electronic medical record;
  • introduction of modern approaches to service during the passage of VVK (accessible and convenient service);
  • implementation of information support (hotline) and the introduction of information products that will help the military get help.

Who will definitely not be “taken”

Yes, according to the lawthe list of those who are not recruited during mobilization includes:

  • booked persons,

  • persons with disabilities,
  • temporarily unfit for service due to health reasons (here the conclusion of the military medical commission is required – it is given for up to six months, and the sweat is back to VVK),
  • women and men who have three or more children under the age of 18,
  • women and men independently raising a child (children) under the age of 18,
  • women and men raising a child with a disability under the age of 18, or an adult child with a disability of group I or II,
  • women and men raising a sick child (damage to the nervous system, severe congenital malformations, rare orphan diseases, oncology, mental disorders, type I diabetes, etc.),
  • adoptive parents, guardians, custodians, adoptive parents, educators who support orphans or children deprived of parental care, under the age of 18,
  • persons liable for military service who care for a sick wife (spouse), child or parents, as well as if the wife (spouse) has a disability and / or if the parents have group I or II disability,
  • guardians of a person with a disability,
  • women and men who have a minor child (children), and one of the spouses is already doing military service,
  • employees of military administration bodies, military units, enterprises, institutions and organizations of the Ministry of Defense, the Armed Forces of Ukraine, the special communications service, the Security Service of Ukraine, the Foreign Intelligence Service, the National Guard, the State Border Service, the National Police, the Economic Security Bureau, the NABU, the SBI, the State Executive Service, the State Security Department.

It should be noted that the above persons can still be called up for military service, but only with their consent and only at the place of residence.

That’s not all

In addition, the following are not eligible:

  • students, graduate students and doctoral students (only full-time or dual forms of study),

  • scientists and teachers,
  • women and men whose close relatives died or went missing during the ATO from among the military, volunteers, persons involved in ensuring the conduct of the ATO,
  • women and men whose close relatives died or went missing while implementing measures to ensure national security and defense, repulse and deter the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, as well as to ensure national security and defense, repulse and deter armed aggression against Ukraine during martial law.

Recall that mobilization in Ukraine has been going on for more than a year. It was declared along with martial law after the full-scale invasion of the Russian Federation. During this time, the mobilization has been repeatedly extended and at the moment it has been announced until August 18, 2023. However, this period is not final and can be extended again.
