The victim suffered severe injuries, including a skull fracture, a broken right eye socket, and bleeding in the brain, following an attack by her 85-year-old neighbor on August 7 of last year. The incident was the culmination of a decades-long feud between the women, with the suspect reportedly convinced her neighbors were trying to make her life miserable.

Substantive treatment revealed that the suspect suffers from delusions. The court described the attack, stating that the suspect, fueled by immense anger, stormed at her 82-year-old neighbor with an ax, striking her head multiple times.

The court deliberated on the necessity of TBS (Terbeschikkingstelling), a treatment measure rather than a punishment, for an elderly suspect with a clean criminal record, save for a past fine for nuisance. However, the court deemed TBS with conditions essential due to the long-standing and intense nature of the suspect’s delusions.

While the suspect is currently taking prescribed medication, the court expressed concern about her future compliance, noting that she had previously stopped medication when not under obligation. Psychiatrists and psychologists involved in her examination concluded that the woman does not perceive herself as ill.

The court fears the potential consequences if the suspect were to live near new neighbors without adhering to her medication regimen. TBS with conditions means the convicted individual does not need to be admitted to a clinic but must strictly adhere to court-ordered conditions. These include maintaining distance from her former neighbors, continuing medication, and refraining from committing further offenses. Failure to comply could result in admission to a TBS clinic.

The woman has also been ordered to pay restitution.
