WASHINGTON โค- Former President Donald Trumpโข hasโข accused Federal Reserve Governor Lisa Cook of mortgage fraud, allegations that highlight the difficulty of prosecuting such cases even when discrepancies exist in property ownership โขrecords. โThe โaccusations centreโ on โCook’s designation of a property as โher primary residence.
According to public records, cook listed a โpropertyโฃ in Ann Arbor, Michigan, as โคher primary residence โขwhile concurrently holdingโ a mortgage on a separate property in Washington, D.C. This raised questions about whetherโค she misrepresented โherโฃ primary residence to secure a more favorable โmortgage rate. โTypically, a primary residence is defined as the place where anโข ownerโค spendsโฃ most of theirโ time,โ votes,โ files tax returns, and receives mail, explained mortgage fraud โขexpert Campo.
A 2023 report by the โFederal Reserve Bank of Philadelphia โขidentified over 22,000 instances ofโค “fraudulent borrowers” โmisrepresenting owner-occupancy status between 2005 and 2017,โข based onโฃ a sample of overโค 15 million loans. The report found these borrowers โคtended to take out larger loans and had higher mortgage default rates.โข However, the authors โฃnotedโฃ that such fraud is often “difficult to detect until long after the mortgage has been originated.”
“There is a difference between theโข court of law and the court ofโ public opinion,” said Jonathan edges,a law โprofessor at Washington University inโ St. Louis and formerโ Assistant Attorney General, in aโฃ recent CNBC interview. “In the court of law, this is small ball โฃand very difficult to prove.” โฃHeโ elaborated that prosecutors โwould need toโข demonstrate not onyl an inaccurate โคform submission but also “the specificโข intent โto deceive, toโ defraud banks, asโ opposed to just makingโ aโ mistake.”
Federal sentencing โdataโค shows โ38 mortgage fraud โฃoffendersโค were โขsentencedโฃ in โฃfiscal year 2024, aโค slight increase from 34 in โค2023, but considerably โขdown from 426 in 2015. The U.S. Sentencing commission dataโค does not categorize theโ specific types of mortgageโค fraud.
