Trump Appeals to Supreme Courtโฃ Overโ Tariff Legality
Washington,D.C.- August 26, โข2025 – President Donald Trumpโฃ has requested the Supreme Court โto โคexpedite a reviewโฃ of lower โฃcourtโค rulings thatโค deemed most of his tariffs illegal.โข The appeal, filed Wednesday night, seeks to overturn a โคrecent decision by the โคU.S.Court of appeals for โthe Federal โขCircuit.
The Federal Circuit,โ in a 7-4 ruling, determined that Trump exceeded his presidentialโ authority whenโฃ implementing the โฃbroad tariffs levied on goods from virtually all โขcountries. This โขdecision casts โฃdoubt on a key component โof โคTrump’s trade policy.
Trump is requesting the Supreme Court โคto hear arguments inโฃ early November and issue โคaโข final ruling โคshortly thereafter – a considerably faster timeline than the court’s typical process, which โcould extend into early summer 2026.
Treasury โSecretary Scott Bessent,in a declaration supporting theโข appeal,argued thatโข the lower โขcourt’s ruling “gravely undermines the President’s abilityโ to conduct โreal-world diplomacyโ and his ability toโ protect the nationalโ security and economy of the United States.” Filings submitted by Trump’s legal team also warn that delaying a decision until โคJune 2026 could lead to the collection of $750 โคbillion to $1 trillion in โคtariffs, and subsequently, significant economic disruption if those tariffs were then unwound.
The tariffs were originally imposed using the International Emergency Economic Powersโ Act โ(IEEPA), with the Trump administrationโฃ declaring the U.S. federal deficit โคwithโค othre nationsโค a โnational emergency. Though, โขthe appeals court โasserted โthat “tariffsโข are a core Congressional โpower,” constitutionally vested in the โlegislative โbranch, not the executive.โ The court specifically statedโ that the power to impose taxes, including tariffs, “is vested exclusively in โฃthe legislative branch โฃby the Constitution.”
The โFederal circuit has paused its ruling from taking effect until October โ14th, providing time for โthe Supreme Court to consider theโค appeal and potentially issue a stay of the decision.
Jeffrey Schwab,senior counsel at the Liberty Justice โCenter,representing plaintiffs who successfully challenged the tariffs,stated,”Both federal courts that considered the issue agreed thatโ IEEPA does not giveโข the President unchecked tariff authority.” He expressed confidence in theirโ legalโ arguments andโค highlightedโค the harm the tariffs โขare causing to small โbusinesses, hoping for a “prompt resolution” to the case.
