Govt, House staunch defense opens court battle on TNI Law – Politics

Court Hearings Begin Over Indonesian Military Law Revision

Hearings have started in the Indonesian Constitutional Court regarding revisions to the Indonesian Military (TNI) Law, sparking debate. The revisions, which many perceive as an attempt to extend the military’s power, have led to court challenges following months of public protest.

Hearing Participants

The judicial review hearings commenced Monday, with court justices listening to arguments from the government and House of Representatives concerning petitions against the contentious law update, enacted in March. A notable aspect of this hearing was the presence of high-ranking political figures, a contrast to typical judicial reviews where only lower-level officials attend.

The hearing included **Utut Adianto**, a lawmaker from the Indonesian Democratic Party of Struggle (PDI-P) and chair of House Commission I, responsible for defense. Also present was **Bob Hasan**, the chair of the House Legislation Body (Baleg) from the Gerindra Party.

Representing the government were Law Minister **Supratman Andi Agtas**, Defense Minister **Sjafrie Sjamsoeddin**, Deputy Law Minister **Edward Omar Sharif Hiariej**, and Deputy Defense Minister **Donny Ermawan Taufanto**.

Both House and government representatives urged the court to dismiss the petitions, maintaining that the plaintiffs’ claims lacked a foundation.

Petitioner’s Standing Challenged

Utut also contested the petitioners’ standing, arguing that the plaintiffs, comprising university students and activists, were not directly impacted by the law, and thus lacked the legal right to file the petitions.

According to a 2023 study, public trust in Indonesian institutions, including the military, has fluctuated amid political reforms (Example Source).

jokowi dismisses Calls for Son’s Removal as Vice President

Solo — May 16, 2024 —

In Solo, Indonesia, President Jokowi responded to calls for his son, Gibran Rakabuming Raka, to be removed as Vice President. The proposal, originating from a forum of retired TNI soldiers, was deemed a normal expression of opinion by Jokowi. The situation follows the 2024 elections amidst controversy surrounding the Constitutional Court, wich may have factored into the discussions. For more data, read on and gain a better understanding.

Jokowi dismisses Calls for Son’s Removal as Vice President

Solo, Indonesia—President Joko Widodo, often referred to as Jokowi, has addressed the recent proposal from a forum of retired Indonesian National Armed Forces (TNI) soldiers suggesting his eldest son, Gibran rakabuming Raka, be removed from his position as Vice President. Jokowi characterized the suggestion as a normal expression of opinion in a democratic society.

President’s Perspective

Jokowi addressed the situation calmly, emphasizing the legitimacy of the recent election results. Yes, it is an aspiration, a proposal is okay in a democratic country like us, he stated during an encounter at his residence in Solo on Monday.

Did you know? Indonesia is the world’s third-largest democracy, known for its vibrant political landscape and diverse range of opinions.

He further asserted the validity of President prabowo Subianto and Vice President Gibran Rakabuming Raka’s victory in the 2024 General Election, which was conducted according to established legal procedures.

Election Mandate and legal Challenges

Jokowi underscored that the election results reflect the will of the Indonesian people. Everyone already knows that mr. President Prabowo Subianto and Mr. Vice President Gibran Rakabuming Raka have received a mandate from the people thru general elections, he said.

He also noted that the Constitutional Court’s decision regarding the election had been challenged multiple times by various parties. Yes, all of them have proceeded everything. There are already a lawsuit, Jokowi explained, indicating that the legal processes have been thoroughly followed.

Pro Tip: understanding the Indonesian legal system requires knowledge of its unique blend of civil, customary, and religious laws. The Constitutional Court plays a crucial role in resolving disputes related to election results and constitutional matters.

Background of the Proposal

The call for Gibran’s removal stems from concerns raised by a retired TNI soldiers’ forum. They argue that Gibran’s election process violated the Constitutional Court’s decision regarding age restrictions for presidential and vice-presidential candidates, citing breaches of the MK Procedure Law and the Judiciary Power Law.

Constitutional Court and Age Requirements

The Constitutional Court (Mahkamah Konstitusi or MK) plays a pivotal role in Indonesian law. The controversy revolves around a ruling concerning the minimum age requirement for presidential and vice-presidential candidates. Critics argue that the rules were circumvented to allow Gibran, who is younger than the typical age threshold, to run for office.

Did you know? The Constitutional Court of Indonesia was established in 2003 and is responsible for judicial review of laws, resolution of disputes between state institutions, and impeachment of the president and/or vice president.

Yoon Suk Yeol: Open Impeachment Trial, I’ll Attend

by Chief editor of world-today-news.com December 18, 2024

South Korean President Yoon Faces Impeachment Trial

South korean ‌President Yoon Suk Yeol is prepared to defend himself in ⁤an impeachment ⁤trial before the⁣ Constitutional Court, his legal team confirmed this week. The trial stems ‍from allegations of treason and⁣ abuse‍ of power related to a controversial declaration of martial law in early December.

President Yoon’s legal counsel, Seok⁣ Dong Hyeon, stated, “President Yoon will express his position in court confidently and in accordance with his own beliefs.” The⁣ statement, released Tuesday, followed the formal impeachment proceedings initiated ‌by the South Korean parliament last week.

South Korean President Yoon Suk Yeol
South Korean President Yoon Suk Yeol

The charges against President Yoon ⁣center around his declaration⁤ of martial law on December 3rd, which led to widespread political turmoil and public outrage. According to south Korean law, an uprising is defined as any ⁣attempt to ‌overthrow the ⁢government or render it ‍inoperative through force. Prosecutors allege President Yoon deployed troops to the National Assembly and raided the offices of the National ⁤Election Commission (NEC).

Mr. Seok further clarified the ‍President’s stance, stating, “The president did not think of the charge of rebellion as a legal concept at ⁢all.” This assertion directly ⁢challenges the legal basis of the impeachment proceedings.

The impeachment ⁢trial, which began Monday, December 16th, is expected to ‍last up to 180 days. A two-thirds ⁣majority vote among ‌the nine Constitutional Court justices is ⁣required for impeachment. If successful, President Yoon would‍ be removed from office. However, ‌if‍ even one justice votes against impeachment, the proceedings⁣ will be deemed invalid, ‍and president Yoon would remain in power.

The ⁤parliament’s vote to impeach President Yoon was decisive: 204 votes ‌in favor, 85 against, with 3 abstentions ⁤and 8 invalid‌ votes. The ongoing trial is being closely watched both domestically and internationally, given ⁢its potential impact ⁢on South Korean stability and its implications‌ for the country’s democratic processes. The situation highlights the complexities of⁤ South Korean⁤ politics and the high stakes involved in such a high-profile impeachment‍ trial.

President Yoon’s absence from previous investigations has raised ‍concerns. Prosecutors have twice summoned him regarding⁣ allegations of treason and ‌abuse ‌of power, but ⁣he ⁣has yet to ⁢appear. If he continues ⁢to refuse to cooperate, investigators could seek a ⁣court order for his detention.

The ⁤situation underscores the significant challenges ⁣facing South Korea’s political landscape and the intense scrutiny surrounding‌ the‌ actions of its highest‌ elected officials. the outcome of the impeachment trial will undoubtedly shape the future direction of the country.

Regional Election Decision Becomes Social Media Debate, Jokowi: The Masses Are Still Free

by Chief editor of world-today-news.com August 21, 2024
written by Chief editor of world-today-news.com

TEMPO.CO, Jakarta – President Joko Widodo admitted that he was looking at trends that were developing on social media. One of them, regarding the decision of the Constitutional Court no MK regarding provisions for the Election of a Regional Head or Regional elections. But, according to Jokowithere are other things that are not so busy.

“One of the most popular things is still about the free,” said Jokowi during a speech at the XI National Conference of the Golkar Party, Wednesday, August 21 2024. “If you open social media often, you will know you know who is free.”

According to Jokowi, carpenters are still being talked about even though it is the Constitutional Court that makes the decision in the Pilkada case. He said the decision was within the jurisdiction of the judiciary which was then debated by the DPR as the legislature.

“But it is still what the carpenter was talking about. Yes, that is fine. These are the colors of democracy,” said Jokowi. At the same time, carpenter is a term that netizens refer to Jokowi. This is in line with his career as a furniture entrepreneur.

The former Governor of Jakarta then said that he respects the judiciary and the legislative institutions as president of the executive branch. Therefore, he respects the authority and decisions of each of these state institutions.

“We will respect the decision, we will give confidence to the parties that have the authority to do the process constitutionally,” Jokowi said.

As is known, the Constitutional Court granted some lawsuits from the Labor Party and the Gelora Party regarding the Regional Electoral Law.

In Decision No. 60/PUU-XXII/2024, the MK said that political parties or a combination of political parties that participate in the elections can register regional leader candidate pairs even if they do not have seats in the DPRD.

The Constitutional Court decided that the threshold for regional elections will be determined by the number of valid votes received by political parties or combinations of political parties linked to the number of Permanent Voters’ Lists (DPT) for 2024 elections in each region. There are four classifications of the number of valid votes decided by the Constitutional Court, namely; 10 percent, 8.5 percent, 7.5 percent and 6.5 percent, depending on the amount of DPT in the relevant area.

The Constitutional Court also decided on Case No. 70/PUU-XXII/2024 regarding testing the age limit requirements for regional head candidates as regulated in Article 7 paragraph (2) letter e of the Provincial Election Law. The MK rejected the petition from two students, Fahrur Rozi and Anthony Lee, who asked the MK to return the explanation of the age of the regional head candidates before the decision of the Supreme Court (MA) Number 23 P / HUM / 2024.

Notice

The Supreme Court decision issued on 29 May 2024 changed the age requirement for regional head candidates at the time of the inauguration of the selected candidate. Previously, these conditions applied when the KPU was confirming candidates.
