Schiphol Airport’s Capacity Determined by Ministry: Impact on Flights and Operational Challenges

At the request of the ministry, Schiphol determines how many flights it can handle at peak times. The capacity of air traffic controllers and military police, among others, is taken into account. The document seen by Reuters contains several scenarios

“We are faced with a dilemma. On the one hand, we understand the desire of airlines to fly more than the 460,000 flights that were included in the experimental scheme.” Last month, the Ministry of I&W (Infrastructure and Water Management) decided that a maximum of 460,000 flights would be temporarily suspended because it encountered too many legal objections from the United States and Europe.

“On the other hand, 460,000 flights would already be an increase of 25,000 flights compared to the approximately 435,000 flights that we expect in 2023. And in 2023 there were already the necessary operational challenges,” said the Schiphol spokesperson. The airport is in discussions with the airlines and hopes to provide clarity soon.

Schiphol’s proposal does not come as a complete surprise: both interim CEO Ruud Sondag and outgoing minister Harbers previously hinted that only 460,000 flights would be possible due to operational restrictions.

Not yet the full schedule has been resumed: initially it concerns twenty flights per week, only 30 percent of the flights that the Lufthansa Group previously offered to Tel Aviv.

Lufthansa will fly four times a week from Frankfurt and three times a week from Munich, Austrian Airlines eight times a week from Vienna and SWISS five times a week from Zurich. Ticket sales start next Monday, December 18.

Brussels Airlines will not return to Tel Aviv for the time being: at least not until early February, a decision has yet to be made about the period after that.

Today, Friday December 15, the Lufthansa Group resumed all flights to Beirut in Lebanon. These were also temporarily suspended due to fears of escalation between Israel and the Lebanese terrorist organization Hezbollah and the possible consequences for air traffic.

In the past week, approximately 550 Dutch people and 50 people from other countries have been picked up from the country at war. Especially because reports from state agent Jeroen Kremers show that KLM has not complied with some of the conditions, Kaag writes. Kremers was appointed by the cabinet to monitor compliance with the agreements made.

KLM received financial help in 2020 when global air traffic almost came to a standstill due to the corona pandemic. A group of banks provided emergency credit, guaranteed by the government. In return, KLM had to promise to structurally reduce costs, including through a salary sacrifice for staff.

In various reports, including his latest one, the state agent concludes that the company is not complying with various agreements. In his latest report, Kremers suggested that Kaag consider using the courts to force KLM to comply with the agreements. After examining various options by the two lawyers, this does not seem feasible.

Filing a lawsuit because KLM has not fulfilled the agreement to structurally save costs has a “little chance of success”, the lawyers say. The text of the agreement concluded between the State and KLM is not precise enough for this. A second reason why a lawsuit has little chance of success is that KLM has now repaid the loan. However, the other legal advisor believes that the State still has rights against KLM for the period before repayments were made.

The fact that the State refrains from filing a lawsuit does not mean that the air has been cleared between both parties, according to Kaag’s letter. “Failure to comply with the agreements with the State has undeniably harmed KLM’s social position and does not contribute to support for providing support to individual companies in the future,” she writes. In addition, the government continues to discuss costs with KLM and the need to take action against tax avoidance by flying personnel.

KLM response
KLM, which did not agree with the state agent’s assessment, responded to Kaag’s decision as follows: “Without the government, KLM would not have survived the corona crisis. We are very grateful to the Netherlands for this. In unprecedented circumstances, we have made agreements aimed at maintaining the accessibility of the Netherlands and the continued existence of KLM. That worked.”

The airline continues: “Dutch people can fly directly to 160 destinations worldwide and KLM is again in the black. The loans were repaid in June 2022. We will continue to pay close attention to structural costs and continue to make KLM more sustainable, so that KLM’s competitive position is maintained.”

One of the state aid conditions was to stop facilitating possible tax avoidance. KLM indicates that it still plans to arrange for staff living abroad to pay compensation for commuting. The airline also wants to continue with plans to structurally reduce costs.

The European Commission no longer allows the government to pump money into Air Malta, but the company cannot survive without that support. That is why the Maltese government has decided to start a new state-owned company and start with a clean slate.

The idea is that the new company, KM Malta Airlines, will be more efficient and therefore ultimately able to survive without support. Something similar previously happened in neighboring Italy, where the very loss-making Alitalia was replaced by ITA Airways.

According to the government, KM Malta Airlines will take over Air Malta’s staff (with a new, likely cheaper contract) and have the same fleet size (of eight aircraft). The big difference is that soon there will be “a realistic business model with a sustainable long-term strategy”.

The government is pumping 350 million euros into the new company.

Long consultations with the European Commission
The establishment of KM Malta Airlines is the result of long consultations with the European Commission. As Malta was keen to retain a national carrier to ensure the connectivity of the archipelago, this was the best possible outcome, according to the government.

The last Air Malta flights will take place on March 30, after which KM Malta Airlines will launch on March 31. Anyone who already has a ticket for the period after March 30 can request a refund. This is guaranteed by the government. KM will start ticket sales on December 1.

Since KM will continue to fly seventeen major routes, scheduled services to Schiphol and Brussels do not appear to be in danger, but this must be confirmed at the start of ticket sales. The new airline will only fly with economical Airbus A320neos.

KM will be fully owned by the state in the first years, but later the company will have to be partly privatized by the European Commission. The government will then retain a major interest in society.
