Telecommuters present additional challenges for โคemployers under the HCSO. During the COVID-19โ pandemic, many employees telecommuted from โa San Francisco address and became subject โขto the law, and someโ San Francisco employees โคworked remotelyโค from home and could not come intoโฃ theโฃ city/county during theโข public health emergency. A โ2021 HCSO amendment clarified โthatโ work locations trigger the HCE. An employer must provide the HCE for a covered โemployee when โthe employer’s โoffice or worksite is in San Francisco or the employeeโฃ worksโค from home in San Francisco as a โtelecommuter. Though, the legislation required HCSO โcoverage for San Francisco employees working remotely solely due โขto public health orders. As the city’s public health order eliminated the remote-work advice, HCSO expenditure requirements do not currently apply to employees telecommuting outside โคof san Francisco. this COVID-19 issue may stillโข ariseโ whenโ anโข employer undertakes aโ voluntary corrective action,which โtypicallyโฃ entails a three-year look-back period.
