Current Liability for Failure to Appear on Summons: Administrative and Criminal Penalties Explained

What is the current liability for failure to appear on a summons?

The Cabinet of Ministers of Ukraine, by Resolution No. 1487 “On approval of the Procedure for organizing and maintaining military records of conscripts, military personnel and reservists,” unified the form of the summons, and also provided in detail the procedure for the delivery of summons by the employer to its employees, notes Anton Marynich.

“This resolution is an integral part of the defense legislation of Ukraine and establishes the rules of military registration not only for enterprises, institutions, organizations, but also for citizens,” explains the specialist.

Regardless of whether a subpoena has been served or not, the following duties exist:

  • Be registered with the military at the declared (registered) place of residence, and in case of leaving Ukraine for a period of more than three months – at the place of consular registration in foreign diplomatic institutions of Ukraine.
  • Do not change your place of residence without the permission of the TCC and SP.
  • In person, within seven days from the date of arrival at the new place of residence, arrive with a passport of a citizen of Ukraine and military registration documents at the TCC and SP.
  • Personally notify within seven days the authorities with which they are registered in the military about changes in personal data.
  • Immediately notify TCC and SP about the loss of a military registration document.
  • Verify personal data with registration data in TCC and SP at least once every five years.
  • If the summons has been served, then Attendance at TCC and SP is mandatory.

    Since the rules of military registration are an integral part of defense legislation, the following liability is provided for their violation:

    Administrativethat is fine in the amount of 3400 to 5100 UAH, provided for in Article 210-1 of the Code of Ukraine on Administrative Offences, namely “Violations of the legislation on defense, mobilization preparation and mobilization”. Part 2 of this article applies, since martial law is a special period.

    Criminal: imprisonment for a term of 3 to 5 years, which is provided for in Article 336 of the Criminal Code of Ukraine “Evasion of conscription for military service during mobilization.”

    “Basically, the criterion for distinguishing between administrative and criminal liability is the completion of military training,” adds the Nota Group lawyer.

    If a person liable for military service is declared fit for military service based on the results of passing the military training camp and subsequently ignores the mobilization order (combat order/dispatch order), then a penalty may be applied to him. criminal liability.

    In addition, even without passing the VLK and systematically ignoring the appearance at the TCC and SP for received summonses, the military registration and enlistment office has the right to contact law enforcement agencies for the purpose of entering information about a criminal offense. The form of such a message is provided for by Resolution of the Cabinet of Ministers No. 1487 “On approval of the Procedure for organizing and maintaining military records of conscripts, those liable for military service and reservists.”

    What will change if deputies vote for the bill?

    As for Bill No. 10449, then, in essence, responsibility does not change but it is proposed to expand the powers of the TCC and the joint venture, says Anton Marinich.

    “A new feature of the project is the possibility of applying TCC and SP to citizens “measures of influence” through the courts”he explains.

    It is proposed to give the TCC the authority to go to court regarding application of such measures of influence:

  • temporary restriction of a citizen’s right to travel outside Ukraine;
  • temporary restrictions on the right to drive vehicles;
  • seizure of funds and other valuables of a citizen.
  • Such enforcement measures will be applied by decision of local general courts as administrative courts, which have jurisdiction over administrative cases at the request of the TCC.

    “The initiators of the bill ignore the fact that today the state has sufficient means to influence citizens in the event of failure to comply with the legal demands of a representative of a government body, including the TCC,” says Anton Marinich.

    Summing up, he notes that this is already the second bill from the Cabinet of Ministers of Ukraine, but still it contains a number of shortcomings, conflicts and inconsistencies between the norms and requires significant improvement for the second reading.

    According to the investigation, before being recruited by the Russian intelligence service, each of the defendants was an active participant in pro-Kremlin groups in popular messengers.

    To communicate with the agents, their Russian curator created an anonymous chat for each of them, from which all read correspondence was deleted.

    Who was part of the agent network

    Among those detained was an official from a department of one of the city councils of the Donetsk region. In addition to her, there were two more enemy agents in the area – the ex-head of a local utility company and a resident of Kramatorsk.

    Another member of the enemy group turned out to be a process engineer at one of the defense enterprises in Zaporozhye. The defendant “leaked” intelligence data on the repair of military equipment at the plant’s production facilities to the FSB.

    Another Russian agent turned out to be an official of a transport company from the Odessa region. At the direction of the Russian intelligence service, he collected information about the possible transfer of SUVs to the needs of the Ukrainian Armed Forces.

    What information did they pass on to the occupiers?

    The attackers were scouting the places of greatest concentration of personnel and military equipment of the Armed Forces of Ukraine in the front-line territories. The defendants also tried to discover warehouses with ammunition and fuel and lubricants of the Defense Forces.

    In addition, they were interested in geolocations and operating features of industrial facilities where heavy weapons of the Ukrainian troops are repaired.

    The conflict between Zelensky and Zaluzhny was first discussed back in April 2022. This fund was promptly renamed, but at Bankova this story was used up as a sign that the commander-in-chief also had political ambitions.

    Moreover, there was already a strong foundation for this. Literally immediately after the full-scale invasion, the level of support for the Armed Forces rose to 98%, according to a survey by the Rating group, even higher than the support rating for Zelensky personally (93%). And Zaluzhny, who before the war was not particularly known in wide circles, instantly turned into a popular figure on a national scale.

    Of course, this did not go unnoticed by Zelensky’s team. As interlocutors from various structures and groups within the government team confirmed to RBC-Ukraine, this topic was most actively promoted by the head of his Office, Andrey Ermak.

    The first public manifestations of the conflict

    For the first time, friction between Zelensky and Zaluzhny publicly appeared in the summer of the first year of the war. The reason was the publication of an internal document of the General Staff, which stipulated the need for permission from the military registration and enlistment office for the movement of military personnel throughout Ukraine.

    The document caused a great resonance, Zelensky promised to quickly deal with the situation and called on the General Staff “not to make such decisions in the future without it.” At the same time, the president, of course, denied the existence of any conflicts with the military leadership and emphasized the unity of the team. “I believe that this is nothing to talk about. Mistakes need to be corrected, that’s all,” Zelensky said then.

    Publications by Zaluzhny in the media

    One of RBC-Ukraine’s interlocutors assures: somewhere at the end of last summer, an agreement was reached that Zaluzhny would no longer appear in the media, but would focus exclusively on military operations.

    And on November 1, the famous Glavka column appeared in the British The Economist, along with his more detailed essay on why Ukraine now cannot radically change the situation at the front in its favor and what it needs for this. It was received extremely harshly at Bankova – not only because of the violation of the agreement, but also because of the content: Zaluzhny’s narrative sharply contradicted Zelensky’s narrative that the situation was by no means a stalemate. As a result, first the Presidential Office itself, and then Zelensky personally, made critical statements against the commander in chief.

    But other sources in the Security Forces claim that there was no agreement between the commander-in-chief and the OP to ban his media activities. Although during the Great War there were really only a few interviews with him. And, according to the interlocutors, permission was obtained from the Minister of Defense. As for The Economist column, they allegedly knew about its publication on Bankova, but did not know about its content.

    “Failure” of the counteroffensive

    In addition, the situation was sharply aggravated by the actual failure of the counteroffensive. Bankovaya RBC-Ukraine assures that the primary source of all optimistic forecasts were the generals’ assurances of the success of the deal, which they shared at meetings of the Headquarters and in communication with Zelensky.

    Later, the president and other top leaders of the country broadcast this optimistic narrative in the media. But then it became clear that no grandiose breakthrough of the Russian defense lines had occurred.

    “This really brought Zelensky down. When it comes to some big things, like a counter-offensive, of course, it shows when they don’t tell you the truth,” the interlocutor notes. To RBC-Ukraine’s remark that the Ukrainian Armed Forces did not receive from the West everything they needed for success, in particular in the air, he replies: “What, it wasn’t immediately clear that the Russians would have an advantage in the air? Why paint rosy pictures?” ?”

    About trips to the front

    There were other reasons for conflicts. One of the interlocutors in the military-political leadership recalls how Zelensky, some time after the full-scale invasion, began to go to the front and personally communicate with brigade and battalion commanders – while Zaluzhny was in Kiev for a long time (although, of course, no one from the commander-in-chief personally led people into an attack did not require). “Then the question arose: can the commander-in-chief fully understand the real needs of the people at the front if he himself does not communicate with them,” the interlocutor recalls.
