Mexico City. The Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) reversed the agreement by which the Complaints and Complaints Commission of the INE ordered President Andrés Manuel López Obrador to remove from his social networks the interview he gave to the Russian journalist Inna Afinogenova, in which she spoke in favor of Claudia Sheinbaum.
In a private session, with four votes in favor and one against, this one by Felipe de la Mata, the magistrates approved the project led by Reyes Rodríguez, who pointed out that the measure dictated by the INE “is disproportionate.”
He indicated that limiting the content of an interview “in which the President of the Republic talks about his retirement, the Mexican opposition, the media and the moments that marked his six-year term, would be disproportionate.”
Furthermore, he pointed out inconsistency because when analyzing the Canal Red interview, broadcast on February 20, the Complaints Commission concluded on March 14 that the request for precautionary measures raised by the PAN and PRD “was inadmissible under the argument that, “Since the reported facts are a journalistic exercise, it enjoys a presumption of legality.”
However, he did allow it to be removed from the President’s social networks, considering that some of his expressions “put at risk the principles of neutrality, equity and impartiality in the contest.”
The inconsistency, he explained, lies in the fact that the commission assessed the same facts with a different standard and, in that sense, “if the interview enjoys a presumption of validity, then based on a preliminary analysis, the inadmissibility of the measures must be declared.” precautionary measures requested in their entirety.”
