ICC Victim Depiction & Duterte Case Update
The โคInternational Criminal Court (ICC) is โcurrently navigating the process of victim representation in the case against former Philippine Presidentโ Rodrigo Duterte, whoโ was arrestedโ in March 2025 and is now detained at the โCourt’s facility. The case centers on allegedโ crimes against humanity, specifically murder, linked to his management’s anti-drug campaign, which resulted in at leastโ 6,000 deaths between november 1, โ2011,โ and March 16, 2019.
The ICC Registry recently submitted a โreport to Pre-Trial Chamber I regarding applications for victim participation. Ofโค the applications received, 15 (Group A) met the criteria of demonstrated verified identity, โขproof โof harm, and a โคdirect โconnection to alleged crimes committed during the โanti-drug campaign, representing a total of 29 individuals. An additionalโ 18โค applications were solely for reparationsโ and โare being considered separately. The Registry’s confidential โannex details the reasons โwhy โขapplications in โคGroupโข B did not meet the established criteria. Applications in Group C, where a clear determination couldn’tโ be made, were submittedโ separately on august 20th.
A point of contention has โขarisen regarding the Registry’s proposal to monitor lawyers representing victims.Theโ Office of Public Counselโ forโ Victims (OPCV), led by โฃPrincipal Counsel Paolina Massidda, โformally opposed the โฃproposal in a publicโข filing on Saturday. Massidda argued โขthat such monitoring is “inappropriate andโ without legal foundation,” asserting that the Registry’s โขrole should not extend to overseeing how โคappointed legal representatives fulfill their mandate.
She emphasized that ICC โฃlawyers areโข already bound by a strict Code of Professional Conduct, ensuring ethical representation and client communication. Massidda warned that a new oversight mechanism could compromise counsel independence, undermine โthe Registry’s neutrality, and create an โขunfair disparity inโ treatment compared to defense counsel.โข The OPCV believes existing complaint procedures โwithin the Code of Conduct are sufficient to address any concerns regarding victim representation.
The OPCV โexpressed its โฃcontinued willingness toโ represent victims collectively, individually, โฃor asโข part of a team until permanent โฃcommon legal representatives are appointed.โข Massidda advocated for a โcombination โขof OPCV lawyers and external counsel,notably from the Philippines,citing theirโ cultural understanding,access to affected communities,and ability โto provideโ effective representation.A redacted version of โthe Registry’s filing has been made public, while full reports and annexes remain confidential as per โCourt regulations. Pre-Trial Chamber I, consisting of Judges Iulia Antonnella Motoc, Reine Adรฉlaรฏde Sophie Alapini-Gansou, โand Marรญaโข del Socorro Floresโค Liera, will now review both the Registry’s report and the OPCV’s observations to determine the framework for victim representation during the upcoming confirmation of charges hearing.This hearing will assess the evidence against Duterte for the โalleged crimes against humanity.
