Serving legal Documents to Iowa-Regulated Insurance Entities
Iowa law requires insurance companies and other entities regulated by the Iowa Insurance Division to designate the Iowa Insurance Commissioner as their agent for service of process within the state. This means the division can legally accept legal documents on their behalf.
The Iowa Insurance Division will accept service of process for initial case filings, including notices, petitions, and jury demands. However, the Division does not serve later filings like motions, pleadings, or requests – including subpoenas and garnishments – unless specifically mandated by law. Service is limited to matters within the Iowa court system and does not extend to cases in other states, the federal court system, or other administrative bodies.
To utilize the Iowa Insurance Commissioner as your agent for service of process,please submit the following to the Iowa Insurance Division:
- One original and one copy of each document intended for service by the Division,for each entity being served.
- A cover letter clearly identifying the name of each insurance company or regulated entity to receive service.
- A check payable to the Iowa Insurance Division for a $50.00 service fee per entity being served.
Upon receipt of these materials, the Iowa Insurance Division will officially accept service on behalf of the regulated entity. The original documents will then be forwarded to the entity via certified mail, as indicated on the cover letter. The Division will also electronically file an Acceptance of Service document with the Iowa Courts website. The requesting party will receive an email notification from the court confirming receipt of this electronic filing.
