A recent clarification from the Kerala High Court has affirmed the legality of safety glazing in vehicles, aligning with amendments too the Central Motor Vehicle Rules. This ruling, stemming from a law passed by Parliament in 2004, has implications beyond Kerala, though administrative orders have yet to be issued by governments in other states.
The court’s decision addresses the potential for officials to face liability if such administrative orders are not implemented. consequently, the High Courts in various states are being approached for similar directives. In the absence of state-level action, the central government or the Supreme Court may need to issue guidance on the matter.
