Portugal’s Anti-Racism Commission Faces Backlog of Unprocessed Complaints Amid Political Standoff

The Commission for Equality and Against Racial Discrimination (CICDR) has failed to process any of the 47 complaints received since its establishment as an autonomous entity in early 2024. President Isabel Rodrigues attributes this total administrative paralysis to a political blockade by the PSD, which she claims intends to merge the commission with the Commission for Citizenship and Gender Equality (CIG).

The Administrative Impasse

Created to enforce legal frameworks against discrimination based on race, ethnic origin, nationality, and ancestry, the CICDR remains functionally inert. According to reporting by Público and Executive Digest, the commission has not processed a single case since its inception. Official records show that 39 complaints were filed in 2025, with an additional eight registered until this Thursday.

The core of the dysfunction lies in the lack of formal regulation. Although the law establishing the CICDR as an autonomous body was published on January 15, 2024, the necessary regulatory decree remains unapproved. Isabel Rodrigues has publicly stated that she submitted a proposal for regulation, but it was rejected by political leadership. She asserts that the current delay is a deliberate strategy by the PSD to force an integration with the CIG, a move she argues would undermine the commission’s specialized mandate.

Infrastructure and Staffing Failures

Beyond the legislative void, the CICDR is hampered by severe operational constraints. The commission lacks the permanent staff required to analyze complex legal proceedings. Rodrigues notes that current personnel are hired on temporary, fixed-term contracts that legally restrict their ability to perform the commission’s core functions, such as handling legal sanctions and international relations.

Physical workspace further exacerbates these issues. The facility designated by the Assembly of the Republic is located on the second floor of a residential building, accessible only via a steep, narrow staircase. An internal activity report from June identified critical problems regarding security and accessibility for individuals with reduced mobility. Furthermore, the commission was notified that it could not maintain a public-facing entrance, a restriction Rodrigues deems incompatible with the mission of an entity designed to support victims of discrimination.

On April 29, the CICDR formally alerted the Secretary-General of the Assembly of the Republic to these accessibility and security concerns. No response has been provided despite repeated follow-ups. If a resolution is not reached by the first week of September, Rodrigues indicated that the commission may be forced to seek independent office space, potentially through a private lease.

Impact on Legal Recourse

The Path Toward Accountability

The failure to finalize the CICDR’s regulatory structure prevents the hiring of permanent staff through standard public employment channels. Because the commission lacks a fixed, accessible address, it cannot legally initiate the recruitment process, further stalling its operations. As the backlog grows, the political debate surrounding the commission’s autonomy remains the primary obstacle to restoring its functionality.

Until the regulatory decree is signed and proper facilities are secured, the CICDR remains a symbolic body without the practical, legal, or physical infrastructure to fulfill its mandate.
