Leo E. Smith, recognized as the oldest inmate in the United States and a man who survived eight scheduled executions, has died at the age of 101, according to reporting by the BBC. Smith spent more than 70 years behind bars following a 1949 conviction for the murder of Grover Hart, a night watchman at a Connecticut yacht club, though the legitimacy of his conviction remained a subject of persistent doubt.

Conviction and Lingering Doubts

Smith was a young petty criminal when police arrested him and another man in connection with the killing of Hart, according to BBC reporting. While his co-defendant accepted a plea deal and testified against Smith, leading to a first-degree murder conviction, the evidence underpinning the verdict eroded over the subsequent decades. Witnesses eventually recanted their original statements, and a different inmate later confessed to committing the murder, as reported by the BBC. Major Leo Carroll, one of the police officers who interrogated Smith following his arrest, later testified before the Board of Pardons that he believed in Smith’s innocence, stating he was not even sure Smith was present at the scene, according to the Boston Globe.

Decades Behind Bars and Escapes

Throughout more than seven decades of incarceration, Smith’s time was interrupted by three brief periods of freedom, according to the BBC. He successfully escaped from prison in 1967 before being recaptured 12 days later. In 1974, he walked out of custody to spend Christmas Eve at home, returning the following day, according to prison officials cited by the BBC. He was subsequently granted parole in 1975, but authorities arrested him roughly 10 months later for petty larceny and weapons possession, which constituted a parole violation, according to the Boston Globe.

Release and the Aging Prison Population

Richard Sparaco, the former executive director of what is now called the Board of Pardons and Paroles, told the Hartford Courant that Smith rebuffed multiple subsequent offers to reapply for parole until 2020. That year, authorities granted him supervised parole, allowing him to relocate to a care home designated for elderly individuals within the justice system, according to the BBC.

Smith’s case highlights a broader demographic shift within correctional facilities. Dr. Stephanie Prost, a researcher studying older adults in prison settings at the University of Louisville in Kentucky, told the BBC that aging populations represent an international challenge affecting systems in Australia, England, and the United States. Data from a 2025 study cited by the BBC show that the demographic of individuals aged 55 and older in American prisons surged by nearly 400% between 1991 and 2021, while US Census Bureau projections indicate that at least one-third of the incarcerated population will exceed the age of 50 by 2030.

Researchers like Prost advocate for policies termed “smart de-carceration,” which include compassionate release and elderly or medical parole, to address the high costs and logistical difficulties of managing older inmates suffering from fall risks, incontinence, and hearing impairments within standard prison environments, according to the BBC. However, experts note that very few specialized care facilities are willing to accept convicted prisoners.
