New York Attorney General Letitia James, joined by a multistate coalition of 21 other attorneys general and the state of Pennsylvania, has secured a temporary restraining order blocking the federal government from seizing the personal records of 17 million commercial drivers. The U.S. Department of Transportation and Department of Homeland Security had demanded the data, threatening to terminate federal funding for the Commercial Driver’s License Information System (CDLIS) if states did not comply by August 17.

The Fiscal and Operational Risk to State Infrastructure

The attempted seizure centers on the CDLIS database, a critical repository containing Social Security numbers, dates of birth, and licensing histories for nearly 500,000 New Yorkers and millions more nationwide.

Legal Authority and the Federal Funding Mandate

The conflict escalated on July 26, when the Federal Motor Carrier Safety Administration (FMCSA) issued a demand for the entire five-year history of the CDLIS database. When the American Association of Motor Vehicle Administrators—which operates the system on behalf of the states—raised concerns regarding legal jurisdiction, the administration threatened to strip all federal grants and contracts. By August 11, the association received a subpoena from the U.S. Department of Homeland Security, further intensifying the pressure to transfer the data.

The coalition argues that states hold ownership of their driver records and that federal agencies lack the authority to unilaterally seize personal information that citizens provided to states under the expectation of privacy. This legal standoff forces states into a binary choice: protect the privacy of their constituents or lose the federal funding essential for interstate commerce and road safety.

Supply Chain Vulnerabilities and Data Governance

If the records are transferred, the federal government would obtain the ability to share the data with other agencies without restriction, leaving states with no oversight regarding the handling or protection of the sensitive information.
