Five convicts from the Mallorca casein which the death of Carlo Heuvelman was central, for the time being do not have to pay more than 200,000 euros in compensation to the girlfriend of Heuvelman. They also do not have to pay grief money to his family. The Supreme Court has determined this, after five of the seven convicted men had gone in cassation against the compensation.
The Court of Appeal pointed the girlfriend of Heuvelman earlier compensation from 218,057 euros, which had to be paid by the convicted persons. According to the lawyer of them, “the legal basis” was missing for the allocation and therefore cassation was established.
The Supreme Court has now stipulated that the Arnhem-Leeuwarden Court of Appeal must again see whether the claim is properly substantiated. The Supreme Court doubts whether the convicted people have had a sufficient chance of defending themselves against the claim. When the Court of Appeal will consider the case is still unclear, writes the regional broadcaster NH.
The Supreme Court has also determined that the parents of Heuvelman are not entitled to grief money. According to the judge, grief money is personal and it is only intended to mitigate the suffering of the victim himself. Because Heuvelman fell into a coma after the mistreatment, he was never able to get to know the suffering inflicted. His parents are therefore not eligible for grief money, according to the Supreme Court.
