Netherlands Fines Uber €825M Over Automated Driver Account Suspensions

Netherlands Fines Uber 825 Million Euros Over Automated Driver Account Deactivations

The Netherlands data protection authority has fined ride-hailing giant Uber 825 million euros (US$960 million) for deactivating drivers’ accounts through automated systems without properly informing them, according to a confirmation by a spokesperson at the Dutch data protection authority on Friday, following an agreement reached on Monday.

The Tech TL;DR:

  • Regulatory Basis: The penalty is grounded in European data regulations under the General Data Protection Regulation (GDPR) prohibiting decisions based solely on automated processing without human intervention.
  • Financial Impact: At 825 million euros, it stands as the second-largest penalty ever issued under European privacy law, trailing only Meta’s 1.2 billion euro fine issued by Ireland in 2023.
  • Corporate Response: Uber stated it contests the decision and the fine, characterizing it as disproportionate, and intends to pursue an appeal.

Architectural Context and the Automated Decision-Making Violation

The enforcement action centers on European data regulations stating that individuals should not be subject to a decision based solely on automated processing. According to DutchNews.nl, the case relates to incidents that took place across Europe between 2020 and 2022. The proceedings originated from complaints filed against Uber in France by drivers who had been suspended on suspicion of fraud, such as taking unnecessary detours to increase their fares. Because Uber’s European headquarters are located in Amsterdam, the Dutch data protection authority (AP) maintains jurisdiction over privacy oversight for the firm across the European Union.

Under EU data protection frameworks, automated algorithms cannot act as the sole arbiters of decisions that significantly affect an individual’s livelihood. Companies must ensure human involvement in such workflows and provide affected users with a clear mechanism to object and contest automated flags.

Escalating Enforcement and Regulatory Precedent

This penalty significantly exceeds the AP’s previous enforcement record against the company. Last year, the Dutch watchdog issued a 290 million euro fine to Uber for transferring drivers’ data to the United States, a case that Uber is also appealing. Prior to that, the regulator fined the company 10 million euros in early 2024 over drivers’ privacy rights and 600,000 euros in 2018. All of these regulatory actions stemmed from the initial complaints filed by French drivers.

Uber’s Appeal and Ongoing Defense

Uber stated it contests the decision and the disproportionate fine, and will appeal the ruling. A spokesperson for Uber told Reuters that the company strongly disagrees with the decision and takes drivers’ rights seriously. The firm asserted that its current policies now include human review, allow drivers to contest suspensions, and that it no longer deactivates accounts permanently through automated systems alone.
