Marjorie Taylor Greene Urges Prosecution of Jack Smith After Potential Trump Win

July 7, 2026 Emma Walker – News Editor News

Marjorie Taylor Greene called for the prosecution of Special Counsel Jack Smith following a potential Donald Trump victory on November 5. Speaking on Steve Bannon’s “War Room” podcast on Thursday, Greene alleged that Smith’s actions are “completely illegal,” targeting the official leading federal investigations into election interference and classified documents.

Department of Justice.

The Legal Conflict Over Jack Smith’s Appointment

Greene’s argument centers on the legality of the Special Counsel’s appointment. This is not a new theory. Judge Aileen Cannon previously used the argument that Smith’s appointment was illegal to toss the classified documents case. However, other jurists have not agreed.

D.C. Judge Tanya Chutkan rejected the same argument in separate proceedings.

Greene expanded her target list beyond Smith. Attorney Matthew Graves. Graves has prosecuted individuals involved in the January 6 riots. Greene filed articles of impeachment against Graves last year.

Comparing the First Term to Project 2025 Proposals

During his first term as president, Trump directed the Justice Department to investigate critics and seize reporters' phones, and threatened to fire opponents. However, he faced pushback from Cabinet officials and career bureaucrats who adhered to established norms of DOJ independence.

Current plans, including those detailed in Project 2025 and Trump’s own public remarks, indicate a more aggressive approach. The goal is to install loyalists who would be more willing than the old-guard officials of his first term to go after political opponents.

Feature Trump First Term Proposed Second Term Model
DOJ Relationship Tension with career “old-guard” officials Installation of vetted loyalists
Enforcement Sporadic targeting of critics Systematic use of DOJ against opponents
Institutional Guardrails Cabinet pushback on extreme demands Removal of independent oversight

The Impact of the Wednesday Filing

On Wednesday, Smith’s office released a filing that made public some of the most extreme allegations and evidence regarding election interference. Legal experts claim Trump has "no factual defense" against the evidence presented in this specific filing.
