While CBS disputed Colbert’s characterization of a total prohibition, noting that lawyers merely outlined equal-time obligations, the outcome resulted in the same digital migration to YouTube.

The regulatory friction stems from updated FCC guidance challenging the long-standing assumption that late-night and daytime talk programs automatically qualify for the “bona fide news” exemption under federal broadcast rules. FCC Chairman Brendan Carr has argued that networks cannot assume exemption eligibility when programming choices involve partisan political figures during active election cycles.
