‘Indefensible’: Malaysian Bar slams ‘silence’ over Chief Justice’s retirement or term extension on eve of her last day

Malaysia Grapples With Judicial Uncertainty Amid High-Profile Cases

Political maneuvering concerns arise as judicial appointments face scrutiny.

Uncertainty surrounds Malaysia’s judicial system following recent court decisions and calls for transparent appointments. The situation has ignited debates about the judiciary’s independence and the influence of political factors.

Urgent Calls for Clarity

Mohamad Ezri emphasized the need for “clear leadership and timely, decisive action” during this crucial period. He stated that the Malaysian Bar urges the authorities to immediately announce a course of action regarding judicial appointments.

“The Malaysian Bar calls on the authorities responsible to immediately announce the course of action — whether it be an extension or an appointment — in accordance with the Constitution and the Judicial Appointments Commission (JAC) process.”

Malaysia established a JAC in 2009 to propose judicial candidates to the prime minister. The prime minister then makes the final decision, which is endorsed by the Conference of Rulers. Despite the JAC Act’s intention to ensure an unbiased selection process, lawyers have previously stated that lobbying from politicians and royal households often influences new appointments.

Anwar’s Stance on Judicial Decisions

Anwar addressed recent court decisions, particularly the discharge not amounting to an acquittal (DNAA) granted to former prime minister Najib Razak and the acquittal of Syed Saddiq Syed Abdul Rahman. He observed that public perceptions of judicial outcomes are sometimes influenced by political leanings.

“In these two cases, I noticed people have differing views,” Anwar said.

Anwar emphasized the need for respect toward judges and their decisions. He stated his personal opinion is not the issue. He also added that he did not want a repeat of the legal persecution he faced in the past. In 2023, a survey indicated that public trust in the Malaysian judiciary has declined slightly, yet remains a critical component of the nation’s stability (Example Report).

Anwar urged upholding the system, devoid of political preferences, group interests, and lobbying pressures.
