INDECOPI Fines Comic Con 25 Producer Nearly S/ 1 Million for Cancellation
Peru’s National Institute for the Defense of Competition and Intellectual Property Protection (INDECOPI) has levied a substantial fine against Fun For Fan S.A.C., the company behind the cancelled Comic Con 25 festival, totaling 182.85 UIT (approximately S/ 978,247.50). The action comes after the event, originally scheduled for March 1-2, 2025, at the Videna de San Luis, was called off, leaving ticket holders and fans of featured guests-including Joseph Quinn, David Yost, René García, Gina Sánchez, and Dani Virgen-disappointed and seeking refunds.
The sanction stems from multiple violations, including failing to deliver the promised service, providing inadequate information regarding refunds or rescheduling, and ignoring consumer reimbursement requests. INDECOPI’s Consumer Protection commission No. 3 (CC3) has ordered Fun For Fan S.A.C. to fully reimburse all ticket purchasers, irrespective of whether they filed a claim, within 15 business days. Additionally, the company’s general manager, Jean Pierre Ortiz Sasai, was personally fined 13.99 UIT (S/ 74,846.50) for his involvement in the infractions.
According to the CC3 resolution, the producer failed to provide a service consistent with its advertising, did not offer clear guidance on the refund process, and disregarded requests for reimbursement from affected consumers. This first administrative instance is currently subject to appeal; a review by the Specialized Chamber in Consumer Protection of INDECOPI woudl represent the final stage of the administrative process.
