ICE Proposes Liability Insurance to Encourage Local Police to Assist in Immigration Arrests

U.S. Immigration and Customs Enforcement (ICE) is proposing a plan to subsidize liability insurance for state and local police officers, aiming to shield them from personal financial consequences during immigration arrests. According to a planning document published Friday, the agency seeks to remove a key deterrent that has slowed local department participation in federal enforcement initiatives.

Expanding Federal Partnerships Through Financial Protection

Local law enforcement agencies have expressed ongoing anxieties regarding civil liability when executing federal immigration tasks. Under the newly pitched federal insurance initiative, participating officers would secure personal liability coverage of up to $500,000. This policy structure is designed to absorb the costs of legal defense fees, settlements, and court judgments arising from on-duty enforcement actions.

To offset the direct financial burden on individual law enforcement personnel, ICE plans to reimburse officers up to $250 annually. This figure matches the anticipated cost of the specialized liability coverage. The agency detailed the proposal in a procurement document issued to industry officials, soliciting feedback through a Thursday deadline to establish outreach, training, and communication support systems.

The operational framework relies on expanding the agency’s existing 287(g) partnerships, named for a provision in the 1996 immigration law. These agreements allow properly trained local and state officers to interrogate, arrest, and charge individuals suspected of immigration violations. According to data provided to the University of California Berkeley’s Deportation Data Project, arrests conducted through these local partnerships climbed sharply to an average of 3,000 per month during the first two months of 2026. That marks a substantial increase from a monthly average of 250 recorded in 2024 under the administration of former U.S. President Joe Biden.

Fiscal Incentives Drive Municipal Adoption Across States

The federal push aligns with broader financial incentives offered to participating municipal and county departments during the second term of U.S. President Donald Trump. Participating jurisdictions qualify for direct federal funding streams to help absorb operational expenses, including officer compensation, vehicle acquisitions, and tactical equipment purchases. Driven by encouragement from state and local Republican leadership, law enforcement agencies across Florida, Texas, Oklahoma, and Georgia have emerged as primary participants in the expanded task force model.

Current data compiled by ICE indicates that nearly 1,600 individual agencies spread across 32 states maintain active agreements to participate in the task force model. By introducing subsidized liability insurance, federal administrators intend to entice hesitant municipal governments that previously withheld participation due to exposure risks.

Criticism Over Accountability and Individual Immunity

Civil liberties advocates have raised sharp objections regarding the structural implications of the proposed insurance scheme. Critics argue that buffering law enforcement personnel from personal financial liability undermines legal accountability mechanisms.

David Bier, director of immigration studies at the Cato Institute, criticized the initiative in a public statement reported by ctvnews.ca. “The concern here is that ICE is going above and beyond to guarantee law enforcement does not have even the slightest risk of liability for violating Americans’ rights while helping ICE arrest people,” Bier stated, having previously advocated for legislative reforms to ease the process of suing federal agents for misconduct.

The administrative mechanism for the program relies on an outside contractor. ICE intends to hire a vendor responsible for managing the insurance administration, processing annual officer reimbursements, and conducting communication outreach. The overall fiscal cost of the contracting arrangement and a definitive launch timeline remain unspecified in the initial agency disclosures.
