HHS Rules Discriminate Against Transgender Youth: Experts Condemn Decision

The Biden administration is facing mounting opposition to new rules finalized this week that restrict access to gender-affirming care for minors, prompting protests and legal challenges. The Department of Health and Human Services (HHS) announced the rules, which effectively bar hospitals that receive federal funding from providing certain gender-affirming treatments to individuals under the age of 18.

The regulations, published Monday, prohibit hospitals from offering gender-affirming surgeries or hormone therapies, arguing such procedures are experimental and lack sufficient evidence of long-term safety and efficacy for young people. HHS officials maintain the rules are intended to protect children from potentially irreversible medical interventions. However, critics contend the policy is discriminatory and disregards established medical consensus.

Attorney General Kwame Raoul of Illinois is leading a coalition of state attorneys general in opposing the new rules. Raoul’s office released a statement asserting the regulations “further reflect HHS’s decision to discriminate against transgender youth despite contrary medical and scientific evidence.” The coalition argues the rules interfere with established medical decision-making between patients, their families, and healthcare providers.

The announcement of the HHS rules immediately sparked protests. Advocates demonstrated outside HHS headquarters, resulting in the arrest of 24 parents and activists who blockaded the building, according to reports. Separately, 25 individuals were arrested during protests organized by activists opposing the restrictions. Demonstrators voiced concerns that the rules will have a devastating impact on the mental and physical health of transgender youth.

The rules reach amid a broader national debate over gender-affirming care for minors, with several states enacting laws restricting or banning such treatments. Opponents of gender-affirming care argue that children are not mature enough to make such life-altering decisions and that the long-term effects of hormone therapies and surgeries are not fully understood. Supporters emphasize the importance of allowing transgender youth to access care that aligns with their gender identity, citing potential benefits for mental health and well-being.

HHS officials have defended the new rules as a necessary step to safeguard children, citing concerns about the potential for regret and the lack of comprehensive research on the long-term outcomes of gender-affirming care. The agency has not yet responded to requests for comment on the legal challenges and protests surrounding the policy.
