Evanston Man Charged After Allegedly Hitting Woman With Truck Over Costco Parking Space
A 67-year-old Wyoming man has been charged with felony aggravated assault after allegedly striking a woman with his truck in a Costco parking lot in Salt Lake City on January 4th. Frank Mysliwiec, of Evanston, Wyoming, was formally charged Tuesday in the 3rd District Court of Salt Lake City, according to court records.
The incident began when the victim and her daughter were finishing their shopping at the Costco located at 1818 South 300 West. The daughter intended to move their vehicle closer to the store entrance to facilitate loading their purchases, according to a probable cause affidavit filed by Salt Lake City Police Officer Eric Martinez. The mother positioned herself in an empty parking stall to reserve it for her daughter’s vehicle.
Mysliwiec, driving a white pickup truck, allegedly attempted to occupy the same parking space. When confronted by the woman, he allegedly accelerated his vehicle, striking her and causing her to fall backward, hitting her head on another vehicle, the affidavit states. A witness reported observing Mysliwiec appearing “visibly enraged” before accelerating.
The victim’s daughter corroborated this account, stating she witnessed the truck accelerate and strike her mother, causing her to fall into another vehicle. Mysliwiec, yet, provided a conflicting account to police, claiming the woman placed her hands on the hood of his truck and he simply revved the engine, causing her to fall backward. A passenger in Mysliwiec’s truck stated he saw the woman fall as the truck “pulled forward.”
Officer Martinez’s investigation included a review of Costco’s surveillance footage, which appears to contradict Mysliwiec’s version of events. The footage reportedly shows Mysliwiec’s truck stopping with the woman standing in front of it, remaining stationary for several seconds before accelerating forward and striking her.
Mysliwiec faces a third-degree felony charge, potentially carrying a prison sentence of up to five years and a fine of up to $5,000 upon conviction. He was initially arrested on January 4th and released under the conditions that he attend all required court hearings and refrain from committing further criminal offenses. Attempts to reach Mysliwiec for comment through two listed cell phone numbers were unsuccessful.
The Salt Lake City Police Department responded to reports of the traffic incident at the Costco near 300 West, according to reports from February 12, 2026.
