Colorado Governor Jared Polis embraces federal tax credit

Colorado Governor Jared Polis embraces federal tax credit

October 20, 2026 Dr. Michael Lee – Health Editor Health

Colorado Governor Jared Polis became the first Democratic state leader to embrace the Trump administration’s new Federal Scholarship Tax Credit, calling the decision an obvious move to secure benefits for local children even as fellow Democrats across the nation remain deeply divided over the program, npr.org reported.

    Key Clinical Takeaways:

  • Governors face a strict January 1 deadline to opt into the Federal Scholarship Tax Credit program for the upcoming year.
  • The U.S. Treasury Department projects the tax credit could generate nearly $26 billion in donations by 2030.
  • Critics warn the program functions as a Trojan horse that could divert crucial funding away from traditional public schools toward private institutions.

The Federal Scholarship Tax Credit Rollout

Beginning in January, qualifying taxpayers can donate up to $1,700 to a scholarship-granting organization, known as an SGO. These organizations convert the donations into vouchers that families can use to cover private school tuition, tutoring, summer school, and new computer equipment. In return for the contribution, donors receive a full dollar-for-dollar reduction on their federal income tax liability up to $1,700. Marguerite Roza of Georgetown University’s Edunomics Lab noted that the arrangement uses money that taxpayers would have otherwise sent directly to the Internal Revenue Service.

The Institute on Taxation and Economic Policy estimates that more than 138 million individuals qualify for the full tax credit. Driven by this financial incentive, the U.S. Treasury Department projects the program could raise nearly $26 billion in scholarship donations by 2030. For comparison, Title I, the federal government’s largest education funding source, distributed more than $18 billion to schools in 2023 to support low-income students.

Republican Governors Lead State Opt-Ins Before January Deadline

State leaders face mounting pressure as the clock ticks toward the January 1 opt-in deadline for participation next year. Thirty-one states have signed on to the program, with the majority led by Republican governors. New York Kathy Hochul joined Colorado’s Jared Polis as the only other Democratic governor to willingly opt in. In Kansas, Kentucky, and North Carolina, top Democrats opposed the measure but faced overrides from Republican legislatures.

Other Democratic leaders rejected the policy outright. Minnesota Tim Walz dismissed participation earlier this year, stating that his state would not opt in. Meanwhile, 15 other Democratic governors and the mayor of Washington, D.C., remain undecided, according to a tracker by Ed Week.

Arguments From Public School Advocates

Opponents of the program argue that the structure creates difficult political wedges for Democratic governors. Jessica Levin, litigation director at the Education Law Center, described the policy as a Trojan horse that entices leaders with promises of public school assistance while ultimately encouraging families to abandon public education for private alternatives. Levin warned that such an exodus leads directly to reduced public school funding.

Public school advocates also highlight structural hurdles within the program itself. Because public schools are legally required to provide education free of charge, they cannot simply start charging fees for core academic classes like mathematics to collect donation dollars. Roza suggested that public districts could theoretically charge for extracurricular items such as field trips, after-school care, assemblies, and tutoring, but critics maintain that such fees undermine the fundamental purpose of public education.

Strategic Pivots Among Educational Foundations

Faced with the reality of an enacted program, some traditional public school advocates have shifted tactics to ensure public students are not left behind. The Southern Education Foundation, which historically opposed private school vouchers, decided to launch an alliance of SGOs focused entirely on raising funds for public school students. Fred Jones Jr., the foundation’s senior director of public policy and advocacy, stated that the organization aims to secure funding for tutoring, summer learning, and after-school programs.

Similarly, former Tulsa Public Schools superintendent Deborah Gist founded the Future School Fund, a national SGO dedicated to supporting public school students. Despite these efforts, analysts note that existing SGO infrastructure heavily favors private institutions, leaving public schools with significant ground to cover.

Concerns Over Equity and Wealthier Districts

Researchers caution that the program could exacerbate existing resource disparities between affluent and low-income communities. Jon Valant, senior fellow at the Brookings Institution and director of its Brown Center on Education Policy, estimated that wealthier counties will likely generate roughly three times as much funding through the program as the nation’s poorest counties. According to federal estimates, household income eligibility extends up to 300% of the gross median income in a given area, meaning roughly 95% of all students qualify. Valant warned that the structure risks operating effectively as a Title I program for affluent children if wealthy donors continue the established pattern of directing funds exclusively to their local communities.
